If I was the defense attorney I would challenge that test.
I am pretty damn sure that is a medical impossibility. Somewhere right after .40 you go into a coma and don't wake up.

Not true for professionals, some can be acting normal at that level.... seen it in the ER too many times

Probably bogus. If I were the defense attorney I'd be all over the fact that there's a distinct "Suspected Driver" version of the lab. That's like sending a drug testing lab a test order for "CHONG, TOMMY." Just next-level stupid.

Yeah, not really. .
Greatly depends on person and tolerance.
Highest I've personally witnessed was .688 with a young Hispanic female and she was awake, but stuporous. She got tubed as a precaution.
