There is a vigorous debate about whether the community care exception can apply to searches of a person’s home as well as of their car. Vehicles have always had less 4th Amendment protection than homes, which are considered a person’s most private sphere. Federal courts have been divided on this question and the Supreme Court has not ruled on it until now. The Court has just announced that it will hear arguments next month on a case that presents this issue: Caniglia v. Strom. In this case, Mr. Caniglia was arguing with his wife and melodramatically put an unloaded gun on the table and said “shoot me now and get it over with.” His wife called a non-emergency number for the police who arrived shortly thereafter. The police disagreed about whether Mr. Caniglia was acting “normal” or “agitated” but they convinced him to take an ambulance to the local hospital for evaluation. The police did not accompany him. While he was on his way to the hospital, Mrs. Caniglia told the police that her husband kept two handguns in the home. The police decided to search his home for the guns without obtaining a warrant. (Mrs. Caniglia’s consent to have the police search their home was legally negated because the police untruthfully told her that her husband had consented to the seizure of any guns.) The police located and seized the two guns. Mr. Caniglia sued for the violation of his 4th Amendment right to privacy and his 2nd Amendment right to keep handguns in the home for self-protection.

Insane times. It seems we are getting to the bottom of that slippery slope....“Shall not be infringed”

For the sake of Police, I hope they rule that it can not be done.

Well...considering the SCOTUS says that bureaucrats can limit the number of people in a church service and what they can do while in there "for the good of society," I don't hold out hope for a good outcome here.

Any conservatives on here still think cops are the good guys?

SCOTUS is compromised and as corrupt as the FBI, CIA, DOJ and IRS.
People continue to hold out false hope that the Republic fka the USA still has good guys coming to the rescue. There are no good guys riding in to save the day in this 3rd World level cesspool of corruption.

How in the holy frick can this even be an issue for the court to decide? NO they can’t do this. Well, we’ve got the war on the 1st and 2nd Amendment, I guess we may as well watch them gun for the 4th as well.

It’s for your own protection though. Don’t you want to be safe? Do you want an insurrection in your place of business?

Let me be clear, no you do not. The mental trauma alone will follow every member of Congress for the rest of their lives. Maybe even beyond.

We must put a stop to this before it’s too late. If you disagree, we’ll just consider that a hostile threat of your true future intentions.

No one is safe if you have a gun. You can only be safe if you turn them all over to us. Promise.

HR 127 will be THE beginning of the real revolt!

There are millions of Americans that will not accept gun control....watch and see!

GUNS don't kill people, Bad people kill people.

Additionally, there are an estimated 350,000,000+ guns in US circulation....think about that for a minute.

This is the case I wish the Supreme Court wouldn’t have taken. Depending on the wording of the opinion, this could definitely be a case of bad facts making bad law.

I won’t say every one, but I have never thought cops were on our side. I have kids in the military, people are going to be surprised there too.

There are some things that have to be learned the hard way. Herding cats, with big claws, is hard.

EVERYTHING, has become about one thing...Global Totalitarian Marxism.

Fascinating time.

In other words, they are about to rule that police may enter and take said guns.

Is this the "red flag law" that I guess has been in use in various locations around the country?

I will be shocked beyond belief if the SCOTUS sides with the constitution here.

This seems like the next step is the total stripping of our individual rights.

My new policy is that every time I read about gun grabbing tactics or legislation, I buy another AR lower, suppressor, 80% or something else that terrifies anti-gun activists.

This is why I think the talk about civil war isn’t as outlandish as some people think. Censorship, invading your privacy, limiting your way to defend yourself, and more. All that, with the backing of Big Tech & Big Business. Great empires have fought civil wars all throughout history, it takes an enormous amount of hubris to think it couldn’t happen to us. When? I don’t know.
