if this is ok, that means police can enter your home whenever they want for any reason they want under the guise of whatever they say.

if this happens communism takes a huge leap forward

And this is one of several reasons that I’m getting out of law enforcement. I take the constitution extremely seriously, especially when it comes to work. I’ll never participate in a gun grab. Aside from the fact that it would be extremely dangerous, I am a strong supporter of gun ownership.

I’ve always been disturbed by the fact our laws are written in a way where two judges can rule on opposite and contradictory sides of the same law, and write long and detailed explanations why.

Its overly simplistic and unfair to lump any group all into the same category. I assume there are no more bad cops on average than there are bad workers in any other field.

Here's the issue

The problem with this case are that large parts are assumed because it was done under summary judgement.
The wife initially told the cops the husband put both the gun and magazine on the table. In the lawsuit she claims the magazine was under the mattress, therefore she knew the gun was unloaded (um, chamber)

The husband claims he went to the hospital because the cops said they wouldn't take his guns. Cops and medical deny this.

Wife denies giving consent even though she led the cops to the guns and didn't object to them taking them. She claims the cops lied to her, the cops denied this.

This would be the millionth reason for cops to always wear body cameras!

Why don't you explain exactly why that is a strawman?

I hope you change your mind. We really need LEO with your principles. If we are going to continue to support the police, we also need police that will support us.

Why do you dolts keep repeating that? Even Scalia said it wasn't absolute.

Obviously, you haven't read this portion of the federal code: §246. Militia: composition and classes
(a) The militia of the United States consists of all able-bodied males at least 17 years of age and, except as provided in section 313 of title 32, under 45 years of age who are, or who have made a declaration of intention to become, citizens of the United States and of female citizens of the United States who are members of the National Guard.

(b) The classes of the militia are—

(1) the organized militia, which consists of the National Guard and the Naval Militia; and

(2) the unorganized militia, which consists of the members of the militia who are not members of the National Guard or the Naval Militia.

I think the issue comes more from the scope of the "community caretaking exception" which is being used to justify the seizure.

It's right there in front of you.

Damn. You do need help. You literally injected an argument no one made, to have something to argue against. Very definition of a strawman. But it did allow you to abandon your previous failed argument. So there's always that.

You are just a chickenshit. Spout off and make a worthless comment and them weasel out when you are called on it.

I really appreciate that sentiment. In my opinion, however, it’s to the point that being in law enforcement isn’t worth it anymore. I cannot do my job thoroughly and properly due to factors outside of my control. I also don’t like the direction that law enforcement is heading; this topic being a prime example. I’m currently job hunting in the private sector. Down the line, I’ll give specific examples of things that have contributed to this once I secure a new job.
