El Paso dropping a curfew on the people

El Paso County, Texas, has imposed a two-week stay at home order with a daily curfew in an attempt to slow the rapid spread of the coronavirus.

El Paso County Judge Ricardo Samaniego issued the order Sunday night, requiring all residents to stay home unless conducting essential business. He also imposed a daily curfew from 10 p.m. to 5 a.m.

Violations could result in a $500 fine.
ADVERTISEMENT

Samaniego recommended that non-essential businesses close if they can't offer curbside, drive-through or takeout services, but did not require it.

Outdoor activities are exempt from the order, as is "essential business" like voting, campaigning, religious activities and grocery shopping. LINK

I also thought that the Texas governor came out and stated bluntly and in an executive Order that was issued that local orders like that are unenforceable

They are, local governments can issue these with no effect. Houston’s County Judge and Mayor were begging for muh shutdowns in July but thankfully were ignored.

It'd be interesting to see how they propose to issue a fine if I'm not required to identify myself simply for being in public.

In Texas, the county judge is the head of the county comissioners--like a mayor for the county and the county commissioners are like city council for the county.

In small counties, the county judge also does judge stuff...hearing cases ("medium-sized" civil suits, criminal matters, family law, probate, etc.). But in larger counties, like El Paso, these court cases are heard by other judges, so the county judge is more like a mayor and not like a judge.
