You must have missed the 3 images in the OP

first image shows that the shooter was moving toward the victim as the slap was initiated

second image shows that the victim had retreated from the position in the first image and the shooter began drawing his weapon while the victim still had the pepper spray at his side, same position as first image

the third image shows the weapon has already been fired before the spray reached the shooter.

The ONLY interpretation from these images is that the shooter started the confrontation, the victim was trying to defend himself from an attack by striking out and retreating, the shooter began drawing his weapon while the victim was retreating, the victim was responding to the shooter drawing a handgun from his waistband, the victim managed to squeeze off a single spray while the handgun was discharging the bullet that would kill him.
