Judge temporarily blocks promotion with BRPD( not so fast Chief Murphy Paul)

BATON ROUGE, La. (WAFB) - A district court judge has issued a temporary restraining order against the Baton Rouge Police Department (BRPD), preventing the agency from moving forward with filling a high-ranking vacancy on the force.
Judge Timothy Kelly’s order remains in effect at least through a hearing he has set on the matter scheduled for Friday morning. The move came after a lawsuit filed by BRPD Lt. Donald Stone, a 29-year veteran of the force.
Stone is represented by prominent Baton Rouge attorney Jill Craft. Stone claims he should have been promoted to the rank of captain when Captain Kevin Newman retired from the force on March 1.
As the law was written at that time, Stone had the most seniority and should have been automatically promoted to captain, the suit alleges. The suit also says BRPD Chief Murphy Paul was bound by state law to make the promotion within sixty days but failed to do so. During that time period, state law was amended to allow a police department to fill the vacancy from “among the five highest in departmental seniority” instead of a strict order of seniority. Well Donald Stone is White so you could see Chief Murphy’s problem

Anyone remember hearing Murphy Paul state publicly (local media clip/interview/article) that he WOULD promote candidates based upon the recommendations of the promotional board?
I am almost certain he said it when he was pitching the new promotional revisions in the State Legislature, just can’t remember which media outlet covered the statement.
It’s my understanding of the new process that the promotional board is only a recommendation. He can choose to promote any of the applicants, despite being scored lower. His only quality control is that he would have to notify those with a higher score of his “reasoning” for the promotion of the less qualified.

I'm torn on this. It's BS that they promote that way and it should be changed, but I think it's very clear why they suddenly got the notion to change it and then railroad this guy out of the promotion.

It is ironic that civil service was created to give AA officers an equal chance in the 60s, but now that Baton Rouge is predominantly AA the leadership wants to do away with it.
