No, he probably just made a really big mistake. But it was a mistake that ended up costing him and others their lives.
Would it change your mind if you knew Ensminger tried to settle with the insurance company but they refused? Are they evil for making a grieving husband go public with this to secure what the law says he’s entitled to?

I feel for this man, but filing a lawsuit is not the way to go. She willingly got on that plane and it unfortunately went down.
You are an idiot.

Has final report come out yet?
I saw the below and hate this kind of crap had to be added to lawsuits.
Regardless of if she heard this just knowing what was happening would cause anyone shock and emotional trauma. It's shouldn't have to be included in lawsuit or article, but it's a tactic and a crappy one. I would only think it would be necessary if insurance and company (can't remember exact set up of plane ownership) were being jack asses and needed some bad press to push them into being reasonable, but they lost family & employees in the crash.

McCord, referred to in the lawsuit by her married name Carley McCord Ensminger, suffered from acrophobia, “commonly known as fear of flying,” and was told before the crash the plane was “going down.”
“Upon learning that a crash was imminent, though the moment of her untimely death onboard PiperN42CV, Carley McCord Ensminger experience severe emotional trauma and panic, as well as shock and damage to her nervous system and psyche,” the suit states.

I’m sure that evil pilot viciously disregarded all relevant standards and drove the plane into the ground. Suing will definitely make it better!
You're coming off dumb as hell rn

Blake Miguez is going to take this state to the next level, I’m talking over 30 publicly traded companies or more

I think if this was just a cash play, he would have sued the Monday after.
If it’s a legit accident, then I don’t agree with the suit. If the owners were negligent then I’m fine with it.
Sometimes the only way to find out what really happened is through the discovery and trial process.

No. Suing is still trashy.

Yea you don’t get to just presume the fault required for this statement to be true.

They can look back at logs and such for maintenance and personnel questions. As for the trauma McCord experienced, I don’t know how that works.
My whole point is that it’s worth gathering information, finding out what happened, and if it can be proven that some person or entity’s actions caused or contributed to the crash, that should be determined. And our system allows for compensation when that is established. Who could seriously argue with a widower wanting to get to the bottom of what caused the crash and IF negligence is proven, he should be allowed to seek appropriate damages.

Poo yieee, I can’t wait. The only tradeoff is that in exchange for making it da capitalist paradise, everyone at the new jobs has to wear Costas and a fishing shirt at all times.

This is why I’d be scared to ever have jury decide anything important in my life.
Once you realize you’re in the margin of error territory for intelligence, it becomes difficult to let inferior intelligence decide for you.

oh man.
Is there ever a scenario where suing is not trashy?
Is there ever a scenario where an insurance company should pay out on a claim?

You don’t really agree with that. How do you propose parties should settle differences? I’m all ears.

1) Very rare, but sure
2) always, up to and including the amount agreed to by the underlying policy

But what do you do if the insurance company won’t pay what they should?
Posted on 5/15/20 at 11:17 pm to tigerskin
Wow. I happened to drive by the site earlier today. Feels so weird going in that post office.
I think chasing money is futile right now. NTSB needs to complete their investigation. People forget the owner of the plane lost pretty much his whole family. He’s a victim too.

Obviously by filing suit and subsequently settling with insurance companies. I mean how else would one handle loss?
