If it has been in place for 30+ years and not contested you have a prescriptive right to the line as it sits. As stated earlier, you should keep your head down and make the necessary repairs. Would be best to rework it to the degree where tractors and other equipment can't damage it in the future.

This is the correct answer and there are, as usual for the OT, a whole bunch of people talking out their arse in this thread. I know because this is the case with my house and the lawyers hashed this out for me previously.

True but what does that do as far as allowing him to dig up their property to access the line?
