They can't just arbitrarily put a lien on the house though. If the debt is satisfied they have to remove the lien.

Usually these are reserved for major violations since there is a legal process required to do so.

Do they own the land the house is built on? I guess the zoning of an HOA doesn't make sense to me. Why would they have power over your property? They aren't paying the mortgage, utilities, ect...

You agree to the covenants when you move in, buy the house.

Because you sign the HOA Agreement when buying/building your house giving them that power

Yeah, HOA isn't for me I don't think.

I don't need other people telling me what I can do with my own property. Country life for me is probably what I'll stay with. There are a ton of beautiful properties right on the outskirts of Little Rock that need to be bought

I find this hard to believe.

So in the winter when sundown is at 5pm, you're supposed to take off work to pull your trashcan off the street in time?

Yeah, most people who don't want to live in a HOA shouldnt be in one. They usually don't like taking care of their stuff and don't mind their property being 'that yard' in the neighborhood.

Is your hood gated and are the streets maintained by the neighborhood or the city? if not gated and maintained by the city, I'd tell them their rules are contradicted by laws and to frick off

The HOA rules probably supersede the local laws

Cutting the grass isn't the issue

My problem would be that sally woo who down the road is telling me to cut my grass.

Someone will tell some horror story about HOA nazis, but for the most part it is common sense rules to keep from ruining the enjoyment of everyone else.

If you maintain your yard, you have nothing to worry about.

Just one more reason I'd NEVER live in an area that has an HOA with neo-Nazi type overseers who let a little bit of power go to their heads and ride roughshod over residents with trivial bullshite.

It’s all fun and games till you got to sell your house. Then you learn all about liens.

Boats and trailers not being visible from the street is pretty standard as far as HOA rules go.

the thing you must remember about an HOA is that the owners of the lots in the neighborhood voted and instituted the HOA in restrictive covenants. At the time it was instituted, all of the lots were probably owned by the same guy (developer).

The covenants/HOA becomes a burden on the land, and like a mortgage or other lien, you buy the land subject to the lien or covenants. You cannot take the position that you didn't agree to the HOA rules. well, you can, but you'll lose. By buying something subject to covenants, you have accepted whatever their terms are.

learn what it takes to terminate or modify them and start gathering signatures.

Only an idiot would belong to an HOA and not at least sit on the board.

Idiots complaining about HOA boards are literally paying someone to govern in a way they don't like. So damn easy to control your destiny.
