Otherwise these crooks that all finished at the bottom of their class and aren’t capable of doing real legal work will continue to get rich at all of our expenses. Louisiana has created entire industries of vultures living off of this. Law firms, egged on by our Governor, suing oil companies (imagine why those companies are taking their new projects to Texas). Then as mentioned above, a whole cadre of toe tapper drivers that make a living off being professional victims.

It's not perfect, by any means, but the question was how to blunt the lawyers and this is one mechanism that would also result in lower premiums

How many settle out of court vs. going to trial? The problem is the ones that end up settling before trial. Usually only the cases that are legitimate make it to trial. The rest are pretty much case mill variety that never has a chance in trial and don’t deserve a fraction of the payout received.

Legacy lawsuits are indeed an issue but they’re not what is causing the high auto insurance rates.
That is a combo of bad Prescriptive periods, direct action, and a poor population looking to get rich from a lawsuit brought about by irresponsible promises by trial attorneys who advertise incessantly on tv and billboards about getting paid!
All of these things need to be curtailed.

Another issue that should be illuminated is the hyper sensitivity of our culture to what “offends” them.
To make a lawsuit viable, someone needs to be “offended”. That can mean different things to different people. Sensitivities can be enhanced. I might not be offended but if I talk to a plaintiff attorney, they can be very convincing about making me feel offended. They’re real good at it. They know how to stir the pot as an artform.
They need to sue to make money. To grow business, they need more people to be offended. Broaden the definition of what “offended” means, and presto.... more business!

And you've got it arse backwards. The legit cases settle real quick. If it's a hard impact, plaintiff goes to real doctors, there aren't any priors, and the post accident MRIs are bad, those get closed quickly.
The ones that get tried have serious issues- i.e. guy has three open suits, five prior accidents this decade, treats at a questionable chiro, plaintiff's attorney is being unreasonable, and there are a lot of other inconsistencies in the records/testimony. Those are the ones you try, and more often then not, they typically happen with plaintiff mills.
That or a true liability dispute.
But most of the settled cases are over-valued because of high meds and possible excess judgments.

Hospital and medical next at about $150,000

Thanks for info. I always assumed the opposite. Makes sense. Still a jacked up system when people can get paid for a minor collision with no real injuries.
