Question for OB in regards to suppressor and SOT

A friend of mine bought a suppressor from a dealer in BR last June. HE bought one of their manufactured cans. His stamp was approved 5 weeks ago and the SOT has had the stamp since July 2nd. They put him off from picking it up because of a gun show 2 weeks ago . Last week they finally told him they haven't built it but it should be ready by the end of this week.
My question is how long does an SOT have once they receive the stamp to clear the form 4 from their books? I think its pretty poor customer service not to have a guys can ready within the year.

what serial # did they use when they sent off the F4?
do they just keep a list of serials and say "we'll make this one once it's approved." lmao

I have no idea what serial# they used. I am assuming they have it on the books and like you said we will make it once we get around to it. He has been way more patient than I would have. The kicker was the last call he made to them. They basically told him don't call us we will call you when it's ready.

Most custom shops do not build until approved. Once its all good they start, seems like a gun show was in the way of that. And yes serial# in with app and if not used because of denial can be used for the next man up. Just like it would if you bought a premade can and get denied.

Yeah, that's not the way it works. When you file an ATF form you are attesting that you are in possession of the item listed and that you wish to transfer it. In fact, the Form 2 would have had to be filed giving notice that the item had previously been manufactured just for the Serial Number to be in the NFRTR in order to file a Form 4. Pre-filing a bunch of numbers without having the items manufactured is a serious Regulatory No-No. It was tried, and a bunch of people lost FFL's over it, back when the Assault Weapons Ban came down. People filed that they had manufactured pre-ban AR receivers on hand when they in fact did not. Same thing applies X10 with NFA items.
Pretty sure that isn't what happened here.

This is absolutely correct. I can almost guarantee I know what shop you’re talking about and I’ve seen them do lots of things below board when it comes to ATF compliance if it’s the same one I’m thinking of ??

I think I’d tell the shop to have it by tomorrow or you’d be reporting them after he’s able to get the suppressor of course.

Without literally spelling it out they were born out of the RJF debacle.

My buddy just wants his can and they really have been dicks about it. I Know a few people that have dealt with them and they have never met an estimated time frame on work done.

In all fairness, not that it makes it right, but that is 100% standard in the custom gun business. Customer Service as it relates to delivery dates is ignored and always has been. I have a good friend who pre-paid on a custom 1911 from a famous gunsmith. It was delivered two and a half YEARS late. Crazy.
Has always been that way.

Gleason i'm not saying its the right thing to do according to ATF regs. What I'm saying is that is the way some custom gun shops do it. You'd be surprised at what you don't know happens at these places. And yes that is exactly what happened here. Its a text book custom shop practice

Custom guns, sure. No problem. NFA items, not a chance that should happen. I’m assuming he “pre” serializes the tubes when he submits the Form 2 and just finishes the manufacturing process whenever he feels like it. Still not the way it should be done since a tube with no baffles isn’t a suppressor but it’s not my SOT on the line.

They threaded my CZ 452. Did an excellent job.
But I did show up there after a stupid amount of time for a thread job and demand my gun back. They apologized and got it done by the next weekend, which is still entirely to long to thread a barrel.
I am happy for the 22 suppressor I bought from them for like $100.
