It’s a swamp basin for crying out loud. No one should be building homes in a natural swamp basin.
Hopefully it won’t be a serious issue with this event and both sides can figure things out.

All those people saying Iberville Parish would have to pay if property in EBR flooded because of the aqua dams don’t realize what just happened. EBR is now responsible for any property flooded in Iberville Parish that would not have been flooded if the aqua dams were utilized contingent on the court detetmining that Iberville Parish was wrongfully precluded from deploying the aqua dams.
That’s your expert legal opinion?

If no one should build homes in a swamp basin why is EBRP doing it?

Dysfunctional local government

I don’t care what Parish is doing it. It is stupid.

Now there is a legal basis for Iberville. I don’t see one for EBR. If you’d like an explanation from an attorney you can call one up.

I’m an attorney.
Your legal analysis is incredibly flawed.

Lol. No you won’t.

Exactly, seems like we should not be preventing floodwater from going into a big swamp basin.

Great arguement there, Mr. Attorney.
How about you explain to me how my legal analysis is incredibly flawed?

You can't sue another parish because natural flooding destroyed homes your parish built in a swamp.
This isn't hard.

Well, for starters: it's wrong. Pretty big flaw in it there.

I have it on good authority SG is going after the water damn with all they’ve got.
They have mobilized their SWAT team and are ready.
This could get interesting.

The aqua dams are on the right side of Bayou Manchac Road going towards Spanish Lake, the locks and Bluff Road. This issue has been brewing for a long time, not just the recent threatened lawsuit as stated in the prior post. Given the current development practices being employed by East Baton Rouge Parish developers of dig, backfill and building retention ponds raising developments above grade justifies anything Mitchell Ourso can do to stop EBR from flooding East Iberville. You just can't elevate developments in flood plains without causing severe consequences. What EBR is saying, we can raise our grade level to any level we want and you can't stop us from flooding you. If the developments in EBR we're on grade then they could complain about the aqua dams. In my view this dog won't hunt and will be tied up in the courts for many years. Drainage is within the purview of the individual Parish governments unless The Corps of Engineers are involved. If The Corps of Engineers are not involved then there is no greater authority than the individual parish government. So the final arbiter is the individual Parish Government. EBR can't tell Iberville Parish what to do with it's drainage so in my mind the lawsuit is bogus and unfair. Now, if they want to put pumps in Spanish Lake draining to the Mississippi River that changes the paradigm, everyone poo poos this idea. This will be real sweet if a EBR judge enjoins Iberville Parish from deploying the aqua dams and East Iberville floods, then we will have the typical political fiddle fattle!.

Political, no standing will be overturned. Did you all not read my prior post saying that this is exactly what would happen. Mitchell Ourso will put the Aqua Dams up, EBR judge be damned. Up for re-election, no "P AXXT" judge is going to interfere. Contempt be damned. Anyone can get an injunction! What's the judge going to do, send Mitchell to jail? You boogs need to get a life! And futhermore who in this life is currently following the rule of law or any law at all? Jeffery Epstein, Harvey Wienstein ring a bell.
