So a while back my stepson was caught driving under a suspended license and received a ticket. At the time, his driver's license and license plate were taken. I took him to the OMV and paid all the fines that were owed, and he received a new license and a new plate. I thought that cleared everything up, though the ticket has not been paid yet and his court date is July 24.

So I just checked his DL # on the OMV website and it says his license is "pending suspension" due to the ticket he received. I'm a little confused - is this what will be handled at the court date when we go and pay his fine?

anything can happen in court, it is entirely possible that he gets his license yanked again

does he have the option of just paying the fine, or is he required to show up for court?

the answer to that question will give you an idea of how bad things COULD go

I'd ask a lawyer

1. Your stepson sounds like a POS
2. Why was his license suspended in the first place?

He had a lapse in his insurance, and was put on a monthly payment plan to pay off the fine. He missed one of the payments so they suspended his license. When I took him to the OMV we paid all of the fines, so I thought we'd just have to show up for court and once we showed all of the paperwork, receipts, etc. the charge would be reduced. That's why I was confused to see this when I checked his DL #.

This is likely exactly what will happen. But until this comes to pass, it will be pending suspension.

ETA: yeah you havent even paid the ticket yet. The judgment on the court date will clear his license unless you get a lawyer involved ahead of time. But in this case, if you handled your shite, paid your dmv fines, got up to date on insurance, and show up to court and pay your ticket, the license suspension should be dropped.

It's better to never get a license.

DL's are a money making racket, not to mention you're paying to put your photo in a national database.

Why do you have to go court? Should be a number to call on the ticket to pay the fine or just go to the DA office. Court is typically only if you contest the fine.

Sounds like you should’ve raised your stepson a little better

Your sons driver liscense will be suspended exactly for 1 year from the date he received the tickets. He will be eligibile for a restricted liscense in which he can only drive to school and work. Also it is not valid out of state. A real shite situation, but he will not be able to do anything about it. His punishment is set in stone for 1 year and if you are caught again without a valid excuse with your restricted liscense, it is appealed and your sentence will increase to 2 years. I know this from my personal experience back when I was younger.

Automatic 1 year suspension for driving under suspension.

You need to talk to the DA and try to get the Driving under suspension dropped or changed to something else.

I was wondering if this was something we could pay off in advance, but I assume not.
