What I figured. It was wrapped around an oak in the backyard and kids were a few foot away and everyone started freaking out

My wife wants every snake she sees killed. I always tell her that I killed it and release it back in a little grassy area behind the house. I think she's on to me because the same black racer has shown up a few times

That oak tree is likely to drop a limb on the house in a storm or one of the kids could try to climb the tree and fall on their arse. Better cut the tree down.
