It will fail miserably. One must prove that due to intoxication or insanity that he knew not the difference between right and wrong at the time of commission of the offense. There was much preparation in this case, not to mention the DA surely will attempt to bring in evidence of other crimes, specifically the letter hoax. They should try, and it could easily be admitted. In that case there would be shown an ongoing criminal enterprise over however long tht period was covering the letter up to Chicago hoax. The likelihood of convincing anyone that there was not a moment in that timeframe in which Jussie should have known of the criminality of his actions due to drug fueled insanity....throughout that entire period....good frickin luck. About 90% of all defendants in fed and state courts could use this with success if it werent damn near impossible to execute. Tl;dr

....the standard is actually not able to know the diff between right and wrong and was "utterly incapable" of forming the necessary intent as required by law. Lol naw.
