The BAC limit simply means it is presumed you are intoxicated. If you blow under that you can still be hauled off.
Yep...bullshite law IMO. Cops should not be able to subjectively state that someone is under the influence and arrest them. There needs to be objective data...ie, PBT, blood test, etc.
These JBTs can just say that in their opinion you are under the influence of something and arrest you without any other proof...and if you demand to be allowed to prove your innocence with blood/urine tests, they refuse. I have a serious problem with this.
No, I do not use drugs and have never been arrested for DUI or the above scenario, but I know someone who was. He bonded out, went straight to the hospital where he worked and had blood/urine taken and a complete drug of abuse panel done. All negative because he does not drink or use drugs. Cops were on a power trip.

I’d venture to say that there aren’t too many wrecks caused by someone who blows a .05 or .06 after having 2 beers or 2 glasses of wine at dinner. The people who are causing alcohol related wrecks are driving with BAC a lot higher than that. The lower limit is just a money grab because its not going to do anything to stop the guy that gets behind the wheel with a .12 or .15 BAC and is actually a danger.

Demand your innocence by blood or urine? Is the intox not a suffiencent way to show innocence? PBT’s are not allowed to be entered in court, intox results are.

He will not be convicted if true. If you can prove from your own results and the sample obtained during the testing process, you were clean. You can easily win in court and depending on the severity of the f up, contact a lawyer about civil rights violations or known as 1983 suit.
The Civil Rights Act of 1871 is a federal statute, numbered 42 U.S.C. § 1983, that allows people to sue the government for civil rights violations. It applies when someone acting “under color of” state-level or local law has deprived a person of rights created by the U.S. Constitution or federal statutes.

Well that would be logically. Usually when someone is that high of a bac and driving. It usually doesn’t end well.
I’m not entirely sure how I feel about .05. But I believe in stricter punishment for those folks who’s bac is a at certain level. Some states have harsher punishments for those who blow .16 or higher.

You can blame Utah. But blame the numb nuts who can’t handle any sort of alcohol and gets behind the wheel. With advancement in Uber and other companies. There is no reason to have alcohol and drive. I understand it’s tougher for those folks in smaller rural areas. Just plan a sober ride. It saves lives and also thousands of dollars.

There's a plethora of things which would impair a person's ability to drive more than a .05 BAC would.
Phone usage, fatigue, stress, doing makeup, telling the kids in the backseat to shut up, etc. etc.
Should we start arresting these people too? Maybe we should all just Uber everywhere and all the time just to be safe. Hopefully the Uber drivers aren't tired or stressed either.

I occasionally have a few beers after work across the street from my office for a meeting with a vendor or whatever. I usually keep it to 2. I'm not leaving my vehicle near work, taking an Uber home, waking up and taking an Uber to bring my kid to school and back to my vehicle because I had 2 beers. A big cup of coffee gives me more of a buzz.

Is one too many? If it were your family? I about got killed by a drunk driver a few years ago. I don't want anyone under the influence on the roads. Or distracted drivers for that matter.
