Nah, I'm not on the jury or even the potential pool.
I can make the hypothetical assumption that he is, and ask the spitballing question. That's all that was implied.
He still gets the innocent until proven guilty assumption in the real world.

I highly doubt the Attorney General would make such a mistake on his charges of mailing explosives if they were fake.
