Some other facts about that case: She was not driving, she was in the passenger seat and not driving, and the car was parked at the time of the spill. She was taking the lid off to add sugar/creamer.
McDonald's was warned multiple times that the coffee was being served too hot and was unsafe, they ignored these warnings which was a partial reason for the punitive damages.

Stella Liebeck absolutely had a case. Have you seen pictures of her burns? She wanted her medical bills paid (~$11,000) and McDonald's offered $800. The jury found McDonald's 80% at fault and Liebeck 20% at fault. I'm sick of this case being used as the benchmark for frivolous lawsuits when that's not the case at all.

Also, Stella was only awarded what McDonald's made on coffee sales alone per day at the time.

That was what the jury awarded her: $160k compensatory damages, and punitive damages of $2.7MM or 2 days of coffee revenue. The judge lowered it to $160k and $480k. McDonald's appealed and it was eventually settled for less than $600k.

I agree that McDonalds should have taken care of the medical bills. She got burned because she spilled hot coffee on herself. McDonalds didn't spill it. She did, how hard is that to understand?

Because McDonald's knew they were serving their product at dangerous temperatures, and agreed that coffee served at that temp will cause burns to the mouth and throat when consumed, but did not believe those conditions were important enough to be addressed. That is gross negligence on their part.

I don't care if the coffee is at a balmy 150 degrees. I'm not putting it between my legs.

That case is so misrepresented by the uninformed, it should be permanently banned.

I remember seeing a lawyer talk about this case back around the time it happened. he said the coffee actually burned thru the cup onto her legs and that she did not actually spill it.

The McDonald’s case was actually kinda legit, but good post regardless.

They still serve their coffee at the same temperature. Obviously, it isn't the gross negligence you allude to.

Yeah, but that coffee was way too hot in the first place.

No way a cup of hot coffee should give you the burns she got.
