The auto mills employ a shite ton of people, people who handle the medical bills and appointments, people whose only job is to negotiate with adjusters, investigators, associates to do all of the legal work. It runs itself after a while, especially with a Morris Bart or Gordon McKernan advertising budget.
And you wind up with a bunch of attorneys 2-3 years out of school barley know what they're doing. Settling cases quickly for less than they're worth cause they don't know any better and you gotta pay for all that overhead.

Then I suggest y'all allow the insurance companies to allow a jury for any amount and see what happens.
Can we couple it with doubling, if not tripling, the budgets of the JDCs in order to impanel those juries?
You good with your property taxes going up to facilitate this?

I love how this board makes insurance companies and insurance defense attorneys the guardians of what is morally right and just in the legal world.
LABI is one of the most powerful and well-funded political advocacy and marketing groups in this state.

For an auto case, sure. He's made appearances in high profile class action and MDL-type cases as recently as the early/mid aughts. I can't speak for anything after 2006 or 2007.

This is pretty much the business model for the larger mills, no question. There are a few small/mid sized firms who still do a decent book of business that have an older model - litigation partner, 2 or 3 staff, 2 or 3 associates. Sort of set up similar to a defense firm. The problem is the advertising budget. Once guys like Buddy (Morris Bart) figured out you could just buy the bulk of the auto cases with a certain level of advertising investment (and once the bar associations ended the ban on advertising), that was a license to print money.
And little guys can't break in without money, so it becomes a mostly closed system.

1. Shyster was a jew in a Shakespeare story.
You can become a jew by learning the myths and stories in the old testament and learning to read and recite Hebrew.
2. As a jew I can point to great Jewish legal minds in both reactionary and socialist camps.
3. The guys on tv are usually herding people into a class action but sometimes actually represent in court. Class action can be very lucrative for the attorney. So?
What is your issue that gives you the right to call the clients names?

Based on what? This is a scare tactic. You know, as well as I do, that where they lowered the threshold these things you question have not happened.

It's just a business model of praying on poor people/the less intelligent. Similar to places like Amscot. It's a shame the state bars allow PI lawyers to advertise like they do. It gives the whole profession a terrible name.
Not to mention many of these big PI firms are just burn and churn. Settle as quickly as possible. They don't even know their client's names. And quite a few were built on some illegal practices, like using runners.

And let me expound on this a bit further, there are only 3 states that are at a. $50k threshhold, a few more at 15k, couple more at $10k and most at $5k or less.
How are these states handling, the “extra jury work load”?
There is none, it went away. The frivolous lawsuits went away.

This. They cater to a certain uninformed "clientele".
They really aren't "respected" legal minds, but they do make serious money. Unless you live and breathe your job and work, at the end of the day, isn't that all that really matters?

just like how health insurance hasn’t fallen despite tort reform. Most folk in Louisiana don’t even know tort reform has already happened with med mal.
I agree litigation costs can increase insurance but i don’t know how much, and I’m skeptical insurance premiums would decrease just Bc insurance companies can save some litigation costs.
It’s almost as if insurance companies make a big profit off of having expensive litigation forcing businesses to take on more insurance at high premiums. Then even if tort reform does get expanded, the insurance companies aren’t particularly interesting in reducing rates.
It is almost as if insurance companies aren’t altruistic angels looking out for citizens.

I like how you corrected the dude for preying but you don’t know the difference between shyster and Shylock.

I’m told the only thing Morris Bart does now is consult other attorneys on how to make TV commercials. And it’s a lucrative gig.

That would be “praying”. I think there is some rampant irony afoot here.

You have to make it where it only takes one call. Before the shysters, it literally used to take like 3 calls. But then he came around and it was one call, that's all.

I know of a guy who tried the Family man image advertisements, and it did not get him enough business. He went the cheesy route and the phones blew up.
From what my lawyer friend tells me, people like Morris Bart make their money on real quick and cheap settlements. A few phone calls to insurance companies, and they get a check for $10-$20K just to go away. Do this ten times a day and that's your business.
When I see all those attorney billboards driving from NOLA to Houston, I want to vomit. Same when I am trying to watch Fox8 morning news.

A lawyer I knew in law school went to a Texas town and became the local advertising PI lawyer. Then, when he hit age 40, he wanted to slow down. The problem is he had so much invested in his advertising he had great difficulty extracting himself from that type of practice.
Texas is not nearly as plaintiff's oriented either.
Gordon has a ton of billboards in NW Louisiana - I counted 20 driving from Shreveport to the Texas border on I 20.
