Is this guy going to jail? UPDATE - Murder charge for cop and husband

That is Deputy Shauna Thompson and her husband Terry. These local heroes put their lives on the line to prevent a heinous public urination episode at a neighborhood Dennys, and it just so happened that Mr. Hernandez asphyxiated and eventually died as a result.
Of course, no arrests were made when Deputy Thompson's co-workers arrived. And the included video has all the greatest hits we've grown accustomed to seeing. The dying man being ignored and unaided as he kicks and gurgles. The local hero laying prone on the perpetrator with solid placement of the choke hold. His heroic deputy wife assisting with the immobilization. The ignorant bystander claiming recording the incident is illegal and the videographer will end up in jail. All the usual hits we're used to by now.
So will the spouse of the LEO receive the same "benefit of the doubt" that the deputy would if she were the primary in the fight?
Is anyone going to jail?

ETA: Upon further review, Mr. Hernandez looks to have bloody knuckles.

This is bad. Who in the hell do the bystanders think they are telling the cameraman he is going to jail? I see where one is the daughter. That could get those people charged with intimidation, no?

Why is her non LEO husband taking lead in restraining him? Does he have any right to do this? Being a misdemeanor I'm not sure citizens are allowed to intervene?

Perhaps, but I believe choke holds like those are against most LE departments' policies.

Maybe so. So best case some internal discipline or even fired. But there's all sorts of theatrics a friendly DA can do to make sure there's no prosecution.

Per all the local reports, the "victim" was drunk/loud and walked outside loudly proclaiming he was going to piss. The LEO's husband followed him, confronted him, and the fight started as a result.
