I have no idea if the OP is true or not. But I have a family member who got a first offense DWI in LA last year. He entered pre-trial diversion. Part of the diversion program is no alcohol during the program. You have to get an interlock installed as well. He travels a good bit for work so thebibterlockbwasnt a great option. If I recall correctly, his schedule would have a week at a time with no readings and the monitoring company would take that as an indication that he was avoiding breathing into the interlock. The other option was a small device not much bigger than a key fob. It connected to hiis phone via some app and he would get random alerts about 3X/day that he needed to blow. Had to do it within some time period- like 15 minutes or so. He had to actually film himself while he was blowing and also say a random codeword that would be sent with the notice so they could verify he took the video at the proper time.

After a few months he told me it was inconvenient enough that he almost wished he could have just done the interlock.

All that to say - yes, there is such a thing as in-home breathalyzers instead of interlock, and yes, there are people who are told no alcohol on their first offense.

But I have no idea of the OP is full of it.

So did you read this on reddit?

quote:

I received a 2nd dwi in Harris county (Houston). First dwi was 6 years ago. I am on probation for 18 months. I am ordered not to drink or do drugs for the duration of my probation. I go to my probation officer twice a month, take random UAs, and have in in-home breathalyzer I have to blow into 3 times a day. I messed up 2 months into it and failed the breathalyzer. My PO said it had to be reported to the court, but what will most likely happen is I will be reprimanded by my PO's supervisors and do not have to appear before the judge. That hasn't happened yet. I am a waiter and as part of training did a wine/food pairing for work yesterday in which I spit out every drop of wine. This was at 5 pm. When I had to blow into my breathalyzer at midnight it gave me another "test failed". I realize my folly in all of this and I'm not trying to ask for ways around anything, I would just like to know what will probably happen to me. Tl;dr: failed in-home breathalyzer twice in one month 2 months in to my 18 month probation for 2nd dwi. What is the likelihood of me going to jail or having to get an ankle monitor or extending my probation?

Failed my in-home breathalyzer twice while on probation for 2nd dwi.

Who gets an in-home breathalyzer for a DUI

If you get home arrest. They'll install a landline that detects alcohol. Never heard of anything else. People usually blow at the POs office

You know you could have hired an actual paid lawyer for her and avoided all this.

Hope you made a call to The Texas Law Hawk. His Talons of Justice should have her out in no time.
