My argument is that I mailed a check for the originally owed income tax. I thought it went through and I was in good standing. I filed the last two years and received state and federal refunds with no notice of any issue.

I had changed my address so it's possible they were sending notices to my previous address, but why wouldn't my address have been updated after I filed for my past two refunds under my new address.

As I said earlier, If by some chance they did not receive the income tax payment I sent two years ago I'm ok with paying what I originally owed. I just don't want to be hit with penalties when I had no idea there was an issue.

You can ask for the penalties to be waived but you can't just say "I didn't get a notice so you can't charge me penalty." You are at their mercy at this point unless you can prove you paid this bill before.

You would have noticed that your check you sent them to pay two years ago had not cleared your checking account. Wouldn't that have alerted you that something was wrong?

Or do you not reconcile your checking account periodically?
