"I had a coughing spell after all the powder and dust blew from the airbags deploying. I drank some Nyquil since I didn't have any water in the car and then used breath spray because my mouth felt like cotton," Burton said. Burton was arrested and charged with DUI after his SUV ran off I-20 and hit a sign in Scott County on May 14.
The highway patrol's arrest report shows the lawmaker, from Newton, registered a .10 blood alcohol level that night.

Truth is that cops are supposed to wait 20 minutes for your breath to be clear of any liquor or mouthwash you could've drank quickly before or after the stop. It usually takes longer than that to get to the intoxilyzer 5000.

The article makes it sound like he didn't blow into anything. It says his blood alcohol content was .01. Did they draw blood?

It has no precedence value unless a state court ruled this at the appellate level. And even then, it's a very specific precedent.

My favorite defense has been that he was too drunk to give any sort of consent to blow into breathalyzer.

They didn't take a blood sample at the jail to confirm the breathalyzer?

If you get a breath sample them you don't get avoid sample. The breath analyzer also requires you to wait 20 minutes from the time you start the machine not from the time you have contact with the suspect so it's usually 40-50 minutes from the time you make contact before you get a breath sample. This defense is BS. A lot of times when this happens the officer gets pretty pissed off.

A guy told me, he carried an unopened pint of whisky when he was driving a little impaired, so if he was ever stopped, he would wait on the cop to look in his window, then he would break the seal and take a huge gulp right in front of the officer... Then open his door and go to jail. His defense would be he got nervous around police and needed to calm his nerves. The burden would have to be on the police to prove he became intoxicated before he was stopped instead of after.

Something like this actually happened with me as a witness. Long story, short, drunk on her butt girl plowed through my fence, destroying it, ran down the street, bouncing off parked cars like playing bumper cars, knocked on door, mom opened it, and they stood outside screaming at each other. As I was too shocked to do anything else, I watched them the whole time. Come court time, she told the judge that she was so shook up she dashed inside & took several large gulps of bourbon to calm herself down. I testified that she never went inside. Judge believed me but D.A. told me later that had i not been able to testify, she would have won the case. That she subsequently failed 3 separate sobriety tests would have been worthless.
