Jury Finds Woman Innocent in Protecting her Dog from a Cop

West Virginia, son
thank god for encryption
quote:
Trooper Seth Cook came to the Hupps' house on May 9, 2015, in response to a dispute between a neighbor and Ryan's stepfather. There Cook encountered Buddy, a Labrador-husky mix who was chained outside the house. The dog, whom Hupp describes as "a big baby," ran toward Cook, barking, and Cook backed up. Even though the dog had reached the end of his chain and Cook was not in any danger, he drew his pistol.
quote:
After he heard about the case, Schles contacted Hupp and offered to represent her for free. "I thought it was outrageous, this girl is being charged for standing in her yard doing nothing but saying, 'Don’t shoot my dog,'" he said. According to Photography Is Not a Crime (PINAC), Cook "testified that he was not afraid of the dog, but was following training that required him to kill all dogs that approach him, even if it was chained and wagging its tail as Buddy was doing in this case."
quote:
Hupp told PINAC her case hinged on her husband's video, which they did not have for weeks after the incident because Cook confiscated the phone, which he was unable to access because it was protected by a password. "Without that video, it's just my word against a state trooper," she said. "Nobody is going to believe my word over law enforcement."\

That's fricked up.

WTF is this?

i'd imagine an advocacy group that fights laws enacted to make filming police (in public) a crime

Sounds like a group against police protection against video

Clearly it's an organization that needs to exist. WTF is a cop thinking confiscating a phone from someone for recording an obstruction arrest?

I have a hard time believing that's true. It's more likely that dickhead cop was justifying his actions by lying or at least exaggerating. There is no way that he was "required" by policy to shoot the dog even though he did not feel threatened.

he testified to that, per the article, so i doubt the police would allow him to lie about that. that was probably their defense
"it's fricked up, but it's within our regulatory power" essentiallly

Probably true, but da frick kinda policy is that? So say for whatever reason, the cop doesn't have his gun or taser on him. Is he supposed to beat the dog to death?
I can understand a policy that says a dog may be killed upon a reasonable fear of attack. I cannot understand a policy that says all dogs that approach MUST be killed.

whoa whoa whoa cops are being trained to kill people's pets now??? so if i call the cops for some reason and he comes to my house to file a report and my dog "approaches" him he's trained to kill it?!
wow... im not going to speculate what i would do.
cop would probably have to kill me as well. which im sure he'd have no problem doing

if this is true then every LEO should be sent to camps for reeducation and all LE bureaucrats should be fired.

This is so sad
She should not have been arrested for stopping him from shooting her dog. Geez

FWIW, according to some press release when he first became a trooper, he was homeschooled.
Homeschooled + state trooper = Oy vey!
