I've never thought of it as a crime to open carry on your own property as long as you weren't using the weapon to intimidate or threaten others.

I would confront him to see just what problem he has with you
Walk over to his house and ask to borrow a cup of sugar.

I don't know the specifics. About a year later he ended up lighting his house on fire then using the shotgun on himself in the front yard for everyone to see.

what the neighbor did certainly could be assault, depending on the details

Are you asking me if this person has committed a crime or if he would be arrested? You can be arrested for essentially anything at all, or for nothing. You're not going to be successfully prosecuted for "walking down your driveway to your car" unless you're prohibited from possessing the weapon...or unless you omitted that you decided to give your neighbors a glimpse down the barrel or were screaming that you were coming to kill them. There's nothing to support that walking down your driveway to your car would constitute a reasonable apprehension of receiving a battery.

Ive asked for a single instance where a person who neither drew a weapon nor pointed it at the victim was successfully prosecuted under 14:37. I've even asked where such has been considered to have met the apprehension element. Still nothing.

Everyone's giving the guy a bunch of shite and debating whether it's a crime.
The bottom line if what he said is all true, that is a potentially fricked up situation especially if you have a family. The right thing to do was file a report in case it escalates.

I think that from the start, a lot of people were skeptical about the story and its "out of the blue" nature. OP certainly didn't help that with the cryptic responses he gave over and over until he finally disappeared.
He came here asking why nothing happened via the police and what more could be done. The answer is "nothing" given what he provided.

Brandishing a weapon is indeed a crime
Based on OP story, doesn't sound at all like he brandished anything. Even the OP said he "assumed" it was threatening. LOL, what does that even mean?

Means it made op's butthole pucker up when he saw it. Regardless of how it was being used.

This.
He turned and put his hand on a holstered handgun?
Triggered!

My bare chest and biceps make people's buttholes pucker. Doesn't make them illegal.

If that's true, I'll get your address when I get my foot out of my mouth.
So, is it "is" or "was"?

Not yet, give society a few more years.

Everything in this thread will be evidence when you eventually have to take this guy out, keep that in mind. Also get a camera to document his hostile activities for your future defense.

If he is open carrying and it's not job related he's not someone you should be worried about dude is just looking for attention and is not a threat to anyone

You "assume" he was trying to scare you. Maybe he didn't recognize your car and was being an alert neighborhood watchman like that Zimmerman guy. You should go tell him thanks for keeping you safe.
