Remember when people used to say to keep a bottle of booze in your car? So if you get in a wreck you can say...I wasn't drunk before the accident, I drank after.

If you allow open containers you open the door to all kinds of drunk assholes making that argument.

Open container is way easier to get fixed than dwi and believe me....I've had plenty of both.

If you're drunk behind the wheel it's a DUI no matter when you drank.

If you get out of the car and down a bottle of whiskey the open container law wouldn't apply.

Just saying that there are possibilities that people are not considering. She doesn't look like someone that would be drunk enough to pass out at the wheel at 10 AM. This is going to be more complicated than that I have a feeling.

For instance, she may have a seizure disorder and be on phenobarb. She could have seized at the wheel and when they took her blood she was positive for barbiturates.

Admittedly, that's an unlikely proposition but like I said, my spidey senses tell me this is not going to be as cut and dried as many on this thread think.

I love drinking and driving. I do it all the time, but only on private property, never on public roads.
