That's called "low hanging fruit" girlfriend. Fair game.
Oh, believe me. I've been told all about it.
But that's where this shite gets scary. I had a friend once bring home a girl who was clearly HAMMERED. Nothing she said made sense.. she couldn't comprehend anything I said to her.. etc. He was sober when we arrived at the bar and he first met this chick (he met her because her drunken self just started randomly talking to him). Yes, he ended up getting pretty hammered before the physical act occurred, but he knew he was taking home that low hanging fruit long before he got drunk.
That's where the area becomes really gray for me. A man should never be charged with rape for having mutually drunk sex with someone.. but what about if the situation was like the one I just described?

Reminds me of the NOLA story earlier this year where the gal was claiming rape, with no evidence, after she had 2 Abita Legendary Gators and washed that down with multiple tequila shots.

Here's the bottom line on this subject, one that I think has already been mentioned but I believe it warrants repeating. If women truly want to be fully equal to men, then a drunk man and a drunk woman should be equally responsible for their own actions and the consequences of those actions while they're drunk.

Men and women aren't the same in most respects--especially physically and sexually (obviously our most palpable distinctions). I don't have to choose to pretend because others choose to pretend.

However, to address your concerns, you have to be conscious of the fact that rape, like murder and other assaults, has a human victim. We're not dealing with property crimes, and you can probably argue that rape is right behind murder when it comes to crimes that have the most devastating human impact.
What does this even mean? Are you or are you not advocating that we would have lesser due process standards for allegations of rape?

And before he goes, I know I've got to sit down and warn him about the possible consequences of going out, getting shite-face drunk, and then hooking up with a girl... Namely that girl who was all "go" the night before suddenly deciding she was "raped" the next day.
Personally, I think that lecture should be more about sleeping with someone that you really don't know well, or someone you don't have a relationship with. IMO, it doesn't have as much to do about shite face drunk. He can take home someone who is mildly intoxicated, who then can allege rape subsequently out of shame, or anger. Because honestly, 2 people can both be drunk to a certain extent, and not know of the other is just "drunk" or "shite face drunk".

You need to find better friends.

I am sure that most women who sleep with you feel a lot of shame and embarrassment after.

Rape allegations should be treated like any other crime - innocent until proven guilty.
My post was addressing why the general public has a different view of crimes like rape and murder, but it shouldn't prevent someone from their basic rights.
Perhaps rape crimes shouldn't be publicized until there is an actual conviction? I'm not sure if that is possible, but you would think it would help prevent someone's life being ruined by a false accusation.

Well, you have kids so you obviously tricked one woman into it.

these always boil down to this
girls cannot be held responsible for their actions while they are drunk
but guys should always be held accountable when they are drunk
both guy and girl are drunk, they have sex, girl regrets it, she screams rape, guys life gets ruined
this kind of stuff pisses me off
So a guy drunkenly rapes a girl and you are good with that?

You're assuming that he just didn't think she was fun to hang out with. Guys are always viewed as the predators in these situations, and that it pretty unfair.
Also, I can tell you that lots of girls have drunk sex. Generally, they only cry rape afterwards if they guy turns out to be poor, an a-hole, black, or some combination of those three. Good-looking rich guys never commit rape.

Is it still tape if he passes out with his dick inside her while equally drunk?
