Hit and Run

Someone hit my car in my apartment garage late Saturday night while it was parked. I noticed blue paint on my vehicle and decided to walk around the garage to try and find a blue car with damages. I found a wrecked blue car and the paint matches perfectly. The damages are the same height on both cars but the office says its my word verse theirs. Police were no help and the office of my apartment is 'investigating" the incident. I have pretty much accepted the fact that I will be paying for the repairs but was wondering if there is anything else I should be doing? Ways to frick with the POS?

Get all the info on the blue car and give it to your insurance company. Tell them what's up and see if they'll waive the deductible in light of the fact that you brought them a subro case.

I'm sure it's for no money so they probably won't bother, but that's what I'd try.

Bring him the estimate saying this is how much the damages cost. Then look at him really strange when he asks how you know it was him.

Lines like "Bro, how wasted were you when we talked?" Will help you out.

Yes, there is something you should be doing.

Pursuant to the Errant Driver's Responsibility Act passed back in '72 under a different name, the burden of proof is actually upon the car who's paint color was transferred. If it is just blue paint on your car and none of your paint on his, this is a slam dunk case. I'd expect somewhere in the neighborhood of $200-350K in damages for your pain and suffering. Hit and run is a felony, after all.

If any of your paint is on his car, then oh buddy, do we have an issue. It will be a Mexican standoff in the courtroom. I have my own paint transfer experts come in and do a full materials analysis with blacklights, swabbing things with cue tips, and cool aerosol sprays that reveal cool lasers in the air. It's heady stuff, but you have to get the evidence somehow.

Overall, I move to suppress the OP. Have a downvote. And none of this is legal advice.

Hitting a parked car a property damage claim which usually doesn't carry a deductible.

If there are no consequences for him the same will apply to you right? Do the same thing to him, but not with a car.

leave a note on the car stating that someone witnessed it hitting your car. notify that person that police will become involved if they don't spill the beans. if they don't come forward just file it on your third party uninsured motorist.
