Any Auto Insurance Gurus around (Accident Related)

First and foremost, frick USAgencies. Long read, and yes I'm mad.
I was west bound on a two line highway driving 50mph in a 45mph zone. Guy behind me either was not paying attention or thought I was going too slow. Either way, he tagged me in the back.
I stopped my vehicle pretty quickly, so quickly he has to slam on his brakes. He slides towards the shoulder, I hear pings on my car as he is stopping. He hit some gravel on the shoulder and it hits my car. Guy gets two citations, report is written and he is at fault. This happened on Dec. 18th.
File a claim on the same day. No one calls me for a couple of days, Finally I get a call to setup appraisal. Appraiser looks the vehicle over thinks it is straight forward, guy hit me end of story. I show him the rock pecks on the right rear panel. He tells me he can see what I am saying, but says "I don't know how I can explain it". I tell him I can't help how he explains it, I just know it was not there prior to the accident. I tell him where the accident was, he goes over takes photos, you can see the skid marks going to the side.
Few days go by, I receive a check for $1240.00, no estimate, just a check. I call the insurance company, The adjuster doesn't answer my calls for two days. I finally get someone to email me the estimate, doesn't include the rear panel damage. I call and I call, finally I get ahold of someone who transfers me to a supervisor, who talks to the adjustors supervisor and tells him to call me.
I explain the accident again to him, I am told that would be a supplement if necessary but they aren't accepting liability on that damage. I tell him it was part of the accident, he tells me I have to prove it. He goes on google maps, pulls the location, sees gravel along the shoulder, and submits photos. Tells me his supervisor will call me at the end of the day. I explain to his supervisor what occurred. He tells me it seems logical that could happen, but the fact that I thought the guy may have intentionally hit me, changed the realm of the claim. Because intentional damage they do not have to pay for. He states until they get the police report they are going to deny my claim as in if I bring it in for repair, they will not cover any hidden damages, and will request the $1240.00 back from me due to them not having to pay me.
Today, I purchase the police report. Statement is very generic. No statement from either driver. Basically Driver of vehicle one hit vehicle two while vehicle two was approaching intersection. No mention of any damage or anything. So I send it over to the insurance company. I ask if we can proceed with the full repair of my vehicle, response from supervisor is basically he sees no problem honoring my claim. However, when I call to setup a repair and rental. I am told they are only paying for the bumper and thats it. I tell them what the manager said, he tells me that isn't what he said because he was copied in on the email. I read the email word for word to him and ask for his manager.
She has an attitude from the start, basically unless you have the police report changed, we are not paying for shite. I tell her what her manager told me, she again says I am wrong, I read it to her. She tells me that isn't what he meant, so I ask to be transferred to the main manager.
I speak to the head guy, he tells me, well I spoke with the driver. He said it didn't happen that way, and I have to believe him. I tell him about the email. He tells me well, that isn't what I meant. I meant as far as fixing what we are liable for. Then he tells me I can go through my insurance company and he will pay my deductible if I want the rear panel fixed. Of course I get pissed and blow up on the guy, tell him I'll have an attorney contact him etc.
I ended up cooling off, called the collision center, he tells me from the photos I sent, they may end up having to get into that panel for repair anyways, so it should not be a big deal. So I am like ok, so I'll just call and get them to set me up a rental.
I talk to the adjustor, he tells me that it's Tuesday, and they won't pay for a rental until the parts are in for the car. My point is how do they know what parts are needed until they get in and make sure nothing else is damaged, that way they can order all the correct parts they need. He says too bad, I'm just going to have to wait until the parts are in. I tell him how my exhaust is bent and I am worried it will affect the engine. He tells me if there is an engine issue they will look into it after the repair. Then I tell him that my rental has to be comparable to what I currently drive, which is a luxury vehicle. He tells me they are only required to pay for an intermediate vehicle.
fricking insurance companies. I swear it's bullshite how these little fly by night cheap arse companies refuse to fix shite and act reasonable for their piece of shite clients.
Moral of the story, if you are one of the assholes with these shite policies, frick you. secondly, I know you assholes are in Baton Rouge, so I hope you read this, then I hope you die in a fricking fire.

honestly, man...all of this manuvering that you are trying to do is just gonna give you more grief...you never come out on top in a wreck, so I would just go with the flow and see how the shite comes out...
I doubt that you are gonna get the insurance company to fix a rock peck that may or may not have been there before the accident...same with the bent exhaust...but typically, a good body shop would roll that into the job just to make you a happy customer...
eta: and as far as the rental vehicle, there is no reason why you should expect them to rent a vehicle for you until your current vehicle is unavailable...parts only take a day or so to arrive and they can order them without you leaving the vehicle in the shop...

That's the thing. It isn't like its some tiny little paint chip. It's actual dings with paint missing. Body shop said PDR would not be an option on the repairs.
If it was a paint chip on the hood or the front I would agree it is a losing argument, but the fact of it being on the right rear of the car next to the rear bumper where the impact was, and that I just cleaned the vehicle the day before and it wasn't there. It was part of the accident.

You are out looking for issues. Sometimes you have to pick your battles.
Should have just taken the check and got your damn vehicle fixed. Go bitching and demand more and more and more and you going to end up getting the entire claim canceled. Actually was kinda hoping that would happen to learnt you something.

Anytime I've been in an accident where I was not at fault, I've demanded that the at fault insurance company provide me a rental that's comparable to my current vehicle in terms of size.

Leroy, its not a little dent in my muffler. It's dual exhaust and both are pointing towards the ground a significant amount. And yes, bent exhaust could in fact cause engine problems.
Why would I not demand to be put into a comparable vehicle?

My buddy has progressive and they are the same way. Chick wrecked into him and he had to do all of the legwork to get state Farm to pay. The state farm guy even said how incompetent the progressive chick was and finished handling the claim even though my buddy wasn't insured by them. In the end, progressive ended up raising his rates because he is living with me until he buys a house.
My uncle also had a huge problem with progressive. Got in a bad wreck, had surgery, and had to do physical therapy. They said they wouldn't pay until they got the final total, even though he was supposed to do physical therapy for 6 months. He couldn't afford it, and after the bills got to like $100k, he had to sue them for the rest up to that point because they had only forked over around $10k.
You get what you pay for when it comes to insurance. GEICO or State Farm are the best around here

That's why you buy med pay coverage on your own policy. A lot of it if you dont have your own health policy. OP insurer doesn't have to pay up front for your meds. Your insuer does if you have Med Pay.
