No, he has Liability and UM coverage, so his insurance not involved.

He has an attorney, but attorney told adjuster to deal directly with friend on the PD portion. I get that he's not making any money off the PD claim, but damn, I think he should step in and help out on that portion now that the insurance company is threatening to deduct storage from the PD settlement. Friend is clueless on accident issues, and is just trying to get by until he gets PD check and can buy new car.

Dad had a '80 Chevy Luv, Baby Blue, standard, no A/C but a radio, unlike some of his other trucks. That stick really hindered my heavy petting operations behind the high school.

Yep, and they haven't because "they haven't been able to confirm the facts of the accident with their insured". He'll get this on the back end when he settles, though.

Yeah, attys don't like to work the PD unless they get a third, but many firms will do it as a courtesy for the BI claim. He may wind up having to sue them for bad faith failure to adjust the PD portion.

May be waiting a long time. Best to just move on, get a new vehicle and use funds collected in he settlement to later reduce the loan. Doesn't sound like USAg is going to be reasonable.

Yeah, no doubt they're going to end up paying the PD. Adjuster even seems to admit that. I'm just worried about them trying to throw the wrecker storage fees past 1/3 back on my buddy, and not knowing if there is a valid solution to it. I have no idea what they expect friend to do with the car sitting at wrecker yard. It's undriveable and totaled. Not his fault for accident, why does he have to move it? And where to?


ETA: Xxx, sorry for hijacking your thread, but seemed like a good one to get my question answered.

Vehicle owner has a duty to reduce further damages or costs. Part of that being moving the car from the storage yard, which will be at his cost unfortunately. Should USA accept liability, he should be paid for the car and the towing/storage costs incurred.

If he has collision coverage, Id file a collision claim, eat the deductible and wait to be reimbursed by USAgencies.

Went thru a similar situation with MrsWafer when someone destroyed her car, then "couldn't remember" what happened in the accident. Despite a witness who clearly saw the entire chain of events. Still had to wait on the police report, so I asked our adjuster to handle our veh damages.

ETA I see he doesn't have collision. He can have his car moved to his house, again at his expense, and wait on USAgencies. He can either pay it up front and get reimbursed, or let his car sit and pay the difference from the day they will stop paying until it's moved.
