i truly wonder if they convince themselves after the shot. Kind of a CYA situation. "If I wasn't completely sure I might be in trouble, but if I say I was 100% certain it was an animal, then I'm good to go"

eta: I am not insinuating they are being coached to say that.

The psych said no to that. I obviously have no way to know. he said the brain fills in the parts we can't see.

I don't know how many times my eyes/brain have turned some knob or stump or group of leaves into a critter. Hell, one time, they turned a coon into a squirrel, and according to Mung, they turned a wood duck into a bluewing

At least it wasnt a chicken beaked duck. You'd get way more hazing for that. immature woody hen and eclipse bluewing look a heckuvalot alike.

My brother was accidentally shot by his 12 yr old son 13 yrs ago in Texas. Son shot at movement in brush. Brother wasn't wearing his orange. Tragic accident. Son is grown and doing well. Doesn't seem to have any lasting problems.

I or my firm have defended several of these cases. I have talked to the shooters in detail in private and have been present during their depositions. I have consulted with psychological experts on the issue for trial prep. Let me tell you, these people are convinced they are shooting an animal. Even the guy who shot the man on a 3 wheeler. He just knew he was going to go find a dead hog on that fence line. No amount of training or pre-hunt talk is going to change this.

What is the experience level of these?

Two were adult males in hunting clubs. Too long ago to remember exact details. One of the clubs even had an annual safety meeting before each season. The rest would have been cases I did not work directly on, so I have little memory of them.

Not taking either side of this debate, but too many times recently have I been severely mistaken when I saw one thing, and it turned out to be something totally different.

Most of the time, words that I've read.

Our brains fool us sometimes. Tragic, and I feel for both young men and their families. Victim's family now has to decide how hard to pursue this accident. What a decision if they're friends.

Talking about it is one thing.
. The man said he was on the damn stand with him. What more do you want? In a day when parents are putting kids out on stands absolutely unprepared I am glad he is still with him.

We had a family friend shot and killed by a 12 year old, so it does strike close to home.

It's happened because this guy is an ignorant fricking idiot. This kind of shite used to happen quite often when I was a kid. I know a guy who had the headlight of his four wheeler shot out while driving it at dusk....shooter thought he was a deer.

I wonder what part of these equations results from lack of sleep, over exertion, drugs or alcohol...

That is a terrifying thought.
Some people just don't belong in the woods...period.

I watched a buck circle around a draw in front of me Sat. morning. Decent 8-point...100 yrds away or so. Goes down the property line just out of sight and BOOM..guy on next lease hunting the line shoots, possibly hitting it. I watch the buck run back the way he came. Thirty minutes later here comes The Great White Hunter on an imaginary blood trail straight through a thicket towards my stand. 9:30 in the morning and he is probably 150 yds onto our lease at this point. I wait till he gets about 10 yards away and holler "HEY" at him. He liked to have shite himself.
I ask im what he's doing on our property. He replies looking for a deer he shot. Not a decent buck mind you, but a deer. After drilling him for coming onto the property w/o landowner permission to search for the deer I tell him his deer, if dead, may be lying at the bottom of the draw. If not, he probably wasn't hit bad.
Guy looks at me and asks "It was a buck?"

Are you f-n kidding me. County has a quality buck reg and your shooting at something brown that you can't even identify as a buck or a doe?

F-N moron

Oh and BTW arsewipe...thanks for walking all over MY hunting spot and ruining the rest of my morning.
Thank God the P@Y I saw 10 minutes before he got there didn't head his way or else the dumfrick might have wounded him also.

Reminds of an incident that happened up the road from where I live about five years ago where a guy shot a mom and her daughter while they were riding horses on a national forest designated horse trail:

Sorry to hear about your tragedy. That is what I was wondering about this incident, if he was deer hunting and not wearing orange or if he was squirrel hunting. Didn't read entire thread so sorry if it was mentioned.
