The article doesn't say. I'm curious if he actually dammed up a navigable water body. Considering I make a living off of environmental permitting I fully understand how nonsensical many of these regulations are.
Surely there must be more to this case than the EPA simply wanting to pick on the little guy. I'd be interested in reading an unbiased report, but I admittedly don't feel like doing the research.

I know a dude from Holden that's in jail right now because he dug a hole on his property and started dumping trash in it. The EPA saw him with a satellite and they arrested him.

Beavers are highly regulated.....they do build dams everywhere but those dams are also destroyed on a regular basis.

"The EPA order on Jan. 30 gave Johnson 30 days to hire a consultant and have him or her assess the impact of the supposed unauthorized discharges. The report was also supposed to include a restoration proposal to be approved by the EPA as well as contain a schedule requiring all work be completed within 60 days of the plan's approval."
Dude us merely being asked to comply with federal regulations as would any landowner. His having a stste permit is admirable but there is a federal element that he should have been aware of. If he can make the case that the discharges in question do no negatively impact those downstream (how could they?) then the dam/pond is fine. If, however, he simply refuses to comply, he willbe subject to fines.
There is nothing in this report by Fox news to suggest that the EPA is gunning for this family and their ducks. They built a pond that required some oversite by the EPA. The EPA is demanding that this oversite be completed and if the outcome is neagative (not likely) that the dam/pond be returned to its natural state. Dude appears to be unwilling to do this, which is his perogative, but when the outcome is less than favorable why should anyone feel for him?

My family has built dozens of ponds and have never hired someone to evaluate it for the EPA. This is bogus.

You have no idea how many thousands of dollars it costs to hire a Consultant to survey, analyze and prepare the impact report that would be acceptable to the EPA. None.
You side with Authoritarian FedGov because that's your DNA -- you believe in Big Lefty Government.

The EPA is contradicting themselves. Since he has already built the pond it is a wetlands and he is not allowed to destroy wetlands.

This is a prime example as to why people oppose gun registrations. Make these types of rules, and it bites the law abiding citizen in the arse when they properly follow the rules. All it does is put a big target on your back for government agencies.
If he had built the pond without getting state approval, chances are nobody would have even noticed nor cared especially in rural Wyoming.

Which is a valid statement to make.
And it will be quite humorous to see you try to squirm out an arguement that it's isn't.
If there is really a flaw, the beef should be with the state department for assigning a invalid permit.
I fail to understand the point of permitting in a world where it's my fault that the regulatory agency dropped the ball.
