The part that seems lost on you is that the new cap isn't even fully in effect now. You're basing your entire argument on how the OLD cap operated. Even if they do go over the soft cap, they get into luxury taxes and the price of the contract goes up exponentially. TigerinATL also described how the CAP does indeed keep teams from taking on salary over the cap through S&Ts.
You are trying to mold the facts to fit your answer. You can squeeze that rock all day, but it's not turning into clay for another couple million years.

I got it, but you and I both know that the minute they signed the new deal, the big market clubs were looking for loop holes to make deals work. The luxury tax may be more punitive, but that still won't matter to teams like Brooklyn, New York and the Lakers. Maybe they can't do it through S&Ts, but there are other means. It won't happen, but Paul might choose to just sign for a low ball contract just to go to the team he wants to. He could make up some of the difference through endorsements.
