The owner of Ruby Slipper was quoted in a Times Picayune article as being against food trucks because it is "unfair competition" with restaurants like his. He's butt hurt because food trucks don't have overhead like he does.

I find that logic absurd. Following that line of thinking, there should be no new restaurants, because they would compete with existing restaurants. If your food and service are good, people will go there. I now no longer go to Ruby Slipper.

Signed. I can understand some restaurants concern, I would hate my business stolen from me too. But this country runs on capitalism, deal with it. With so many restaurants against food trucks, in a city known for food, I think it would be difficult to have any reform in food truck laws.

The only stipulation for food trucks that restaurants have a legitimate claim about is that they're not allowed to park and operate within a certain distance from brick and mortar restaurants. Other than that it's not unfair competition.

And I'm pretty sure that is part of the law in almost every city/county that regulates them across the country.

someone raised a good point the other day.

If I owned an empty lot downtown and allowed a couple of food truck to park there. A customer of the food truck trips and falls on the sidewalk and decides to file suit. Who is liable ?

Nah, if they're legally parked, screw the "brick and mortar" joints.

Learn to compete and shut up. I contend each are selling something different (sit down dining versus getting food out of the window of a truck) anyway.

Hopefully you have insurance on your property. But it would depend.

I've been to Ruby Slipper once. I thought it was good. Somewhere I'd go back to, but wouldn't necessarily go out of my way to go back to, ya know? Now, I won't go back.

If food trucks could actually operate in the cbd, I would be very tempted to quit my job and get one.

Ruby Slipper Mid-City is one of the ten most overrated restaurants in New Orleans. I had one of the worst breakfasts of my life there. Yet, we still had to wait an hour for a table for two! The highlight of the morning was walking to the Walgreens on Carrollton and Canal and getting a watermelon flavored Big Shot.

The property owner is virtually always "liable", unless the person tripped on something created by the food truck. (I'm simplifying things a great deal).

However, I wouldn't worry too much about it. Slip and Fall/Premises Liability Law has gotten extremely conservative over the past 15 years, and its extremely difficult for a Plaintiff to collect anything unless the property owner didn't have proper clean up procedures and KNEW about the existing condition and did nothing about it.

I've never been able to fathom the notion or appeal of waiting any amount of time to eat breakfast ANYWHERE.
