Interesting issue. Good for Ciron in trying to get someone who advised the kid poorly to be held accountable.

Buyer beware
The client was 20 - and there was a lot on the line. If I were advising Mr. Black now, I would look into the insurance company practices, because they most assuredley took the premiums.
He thought he was buying protection from the exact type of injury he suffered - either the guy who sold it to him or the guy who advised him to buy it (or both) are straight up wrong if the didn't recover on the policy.

The suit claims McConley "actively searched out" Black, using the Internet and other contacts.
Lesson to be learned there. Hope he gets anything he's due, but the process of hiring a financial planner should have gone the other way.

The fine print is a bitch, especially on insurance policies.

Ciron Black, a standout offensive lineman who was projected as a first-round NBL [sic] draft pick, suffered such an injury against Alabama in his senior season in 2009, and his claim under the policy was denied.
I think I might know why the claim was denied.

Ins Co make profit by denying claims.

What's the difference between a financial advisor and agent? Why wouldn't LSU find out a way to get the kid an ins. Policy if they knew he was going to be a first round pick?

He wasn't going to be a 1st Round pick. That's the thing. Whatever injuries were ailing his knees, they probably started happening sometime before his junior year.

I don't think an undergrad football player can reasonably be expected to learn the details of contractual negotiations over insurance with respect to when nagging medical conditions are covered when there is also an on-field injury.
It's a huge gray area, even without knowing what the advisor specifically told Ciron, and fwiw, I hope Ciron gets some compensation out of this case, because he caught a raw deal with respect to his deteriorating knees (much like Will Arnold).
That being said, the projections going into the 2009 season that Ciron would be a 1st Round pick are laughable.

Yeah I think he may have a legit E&O claim. He was clearly not a sophisticated buyer and as such should have had all of the exclusions in his policy thoroughly explained to him. It is my understanding that Lloyd's athlete policies Solely cover catastrophic injury or death. That should have been explained to him and any professional broker would have had him sign a page stating that he had understood what was and was not covered.

Sounds like a guy that's trying to get a pay day for not making it to the league

Yeah, but in an ideal world, I think he should get a little something. After his first 2 years at LSU, he definitely looked like a top notch NFL prospect. Then, for whatever reason, he lost his mobility. A little of that was noticeable even in his sophomore year, but it was really bad in 2008 & 2009.

And, LSU makes millions of dollars per year charging $4.00 for bottled water and $8.00 for (three chicken strips.)
Just sayin'.

No, concessions are not ran through LSU. Most of the time its a pewee sports team or church group that run the stands.
