Gorsuch is a brilliant dude. I think he's my favorite justice that Trump has nominated.

Clarence is my guy up there but if I were Trump I’d be telling those two to draw up a list of who they’d want to replace CT so he can step down during the Trump admin without risking Newsom flipping the court if he wins or letting the pundits pick another ACB.

Not liking the fact that Roberts doesn't see the comparison between people here temporarily for legitimate reasons and illegal immigrants as a valid one. Doesn't mean he won't go the way I'd like him to on the issue as a whole, given much of the discussion is in regards to the way the text is interpreted and the original intent, but still not a great sign.

I’ve found if you can view watching people like that as comedic relief it helps with cortisol and blood pressure levels.
You just have to think of it like watching a comedy rather than a drama.

That was aggravating. He's always such a little bitch.

Sounds like Robert’s is going against this.

No! Not at all.

He's hands down the best current Justice.
This has been a bloodbath for Trump so far. Alito seems to not be buying their argument, even if he got his political grandstanding in on the way.

I think this could go 6-3 against Trump based on how the arguments are going.
ETA hell, 7-2 maybe. I went back and listened and lionward is right, even Alito didn't seem convinced

Did the solicitor general just admit that under his current argument/logic, tribal Indians are subject to birthright citizenship (after first saying they weren’t).

Thomas has asked 2 questions, and neither was necessarily teeing up the SG to hit a home run.
I could see this going 9-0 after today, but anything 6-3 or more wouldn't surprise me.

He said "yes" then "he has to think about it." Not the answer to give to Gorsuch who has a long history in Indian Law.

Kav's first question of the day coming in hot against the admin's position.
ETA: The rest of his questioning has been the first lifeline the admin has had today.

I wouldn't give up yet. This is their job... Prod the issue to make sure the legal grounds work.
But this is (or at least should be) more about interpretation and intent of the text than it is any arguments that are made.
Not saying I feel great about it, it's obviously not a great sign. But let's just see what happens.

I predicted 7-2 a long time ago. I can't listen right now, but if it's as bad as y'all are saying 8-1 or 9-0 seems doable.
If Alito doesn't seem solid I doubt Thomas would ignore his favored statutory interpretation method AND pull a KBJ and be the lone dissent.

Alito started with a Scalia quote that the SG said was wrong. That's a summary of the day so far.
