Great idea: A law that if a drunk driver kills a parent, they pay child support,.,..

Why would it be limited to just drunk driving? If the principle behind it is that you took someone's life and now you have to pay for their responsibilities, it should apply across the board to any killing that is not justified.

And why just child support? If you cause an accident on the interstate and I miss my flight, you should reimburse me. Let's do that law.

Restitution for crimes isn't a novel idea.

true, good point, not a lawyer but this would seem to crack the door open a bit for appeal if the judge gets a bit creative or overly aggressive?

How is this different from a child recovering lost wages or earning potential of a parent in a wrongful death lawsuit?

The problem is.....

they often get sentences of 10-20 years meaning the child will be of age when convict released.

No idea. My uneducated guess is it would be wise to follow the CS guidelines that are already in use in the state/locality. But I really have no idea.

They aren't. Doesn't kick in until a year after release... so many children will no longer be minors and won't receive a thing.

Restitution is a part of most states' criminal code. It just rarely gets imposed, for some reason.

This is kind of the dumbest shite ever.

What's the average jail sentence for this? 15 years?

Drunkard kills a guy with a 3 year old. Gets 15 years. Kid turns 18. Killer doesn't pay a dime.

frick that.

ETA: I'd actually be okay with a few of my tax dollars going into a fund to raise these kids while the pos killer either gets a lethal injection or 25+ years.
