Dude is spot on but it doesn't matter if you have judges who ignore the law to serve a political end.


ETA - Also, duty to retread is so typically liberal. Why even have a law allowing CW or open carry if you have this stupid law in the books.

Looks like ICE is about to surge here in OH. My dumbass liberal State Senator already put out info on knowing your rights and how to organize. No true sanctuary cities here but one in the comments asked if ICE came to,their home weren’t they protected by Castle Doctrine laws, cause it was their right. I damn near choked on a pretzel.

He's spot-on, but he's omitting a huge detail that for whatever reason everyone else is omitting as well. It has been officially claimed on record that Pretti was not carrying any form of identification.

So let's assume that's true, and break this down. I am a long time concealed carry permit holder. I stay up to date with the laws and even base travel upon where I can and cannot legally carry, and thoroughly research the laws of whatever respective States I may be visiting or passing through.

Rule number one, in every State that has and/or honors concealed permits and reciprocity, is that if you are going to carry a concealed weapon, you SHALL possess, at all times, the credentials that allow you to conceal, when in physical possession of the firearm outside of the confines of your own home. Your physical concealed weapon permit is an official Government ID.

So Pretti, if he had no identification on his person as officially claimed, was committing a felony just by possessing a concealed firearm. He was NOT LEGALLY exercising his State and Federal constitutional right, but ignoring a pretty big stipulation that comes along with this right. And as someone who has been through the class, I can 100% confirm that Pretti not only was taught this law, but also provided his signature that he fully understood it and would abide by it under penalty of law.

Forget the rhetoric on both sides. At this point we havent seen any evidence that he had his hand on his weapon..Was on his back and already peppered sprayed. Gun was removed and shot. Unless he committed crimes against women and children (in which case i wouldn't care what happened to him) can we agree if it wasn't for a protest against ICE or the Somalia fraud, that the situation itself was terrible mistake by the officers. Mistakes are made by humans. Its that simple but politics and hatred everywhere will keep this ongoing.

I believe the shooting could have been avoided. I prefer stating it that way than saying it was a mistake, but that's just me. I'd not push back on anyone insisting it was a mistake.

But a mistaken shooting doesn't necessarily render it unjustifiable. If the officer could have reasonably felt himself in imminent danger in that precise moment, then it can be deemed as justified the way I understand things. I will not pass judgement on him as others have.

Perp is on the ground resisting arrest, another officer yells out "GUN!!", several officers all jump back simultaneously, and within seconds the perp gets shot. That's how I see the video.

It's a tough judgement to make in a split second where the price for being wrong is your life, or that of your peers.

Well said. Personal opinion is feel the discharge of the weapon that was taken off of him spooked them.

And it's reasonable for a LEO to assume the guy fighting them has the gun when another cop yells, "Gun!" Cops don't yell, "Gun!," to let their fellow officers know they have their service pistol on them.

And it's also reasonable for a LEO to assume that when a fellow officer yells, "Gun!," and a shot rings out, that it is the armed perp fighting them who fired the shot.

The LEOs response was completely appropriate for the situation. It was a tragic accident that never would have happened if the dead guy hadn't inserted himself into a lawful federal law enforcement operation.

It sucks for the dead guy, but he's never looked better than his photoshopped media picture.
