Do Judges have any power over the DOJ's investigation of contempt after the Judge refers? Can the Judge appoint a special prosecutor after a DOJ investigation finds no contempt?

I think those are interesting questions. You can see the idea of referring contempt charges to a DOJ that apparently counseled DHS on this issue of letting the flight to El Salvador continue. But that is the rule, and it seems Boasberg is clearly overstepping in investigating it himself.

I don't understand why the Trump DOJ doesn't just challenge this on not getting proper notice.

Boasberg ordered the plane turned around in a early morning weekend ruling while the plane was in the air and in one case over international waters and sent it to the DOJ.

So he's going to hold DHS in contempt when they weren't even notified... for an act that was already effected... on a weekend.... early morning?

I think they are.
I do not know the details offhand, so I might be wrong on specifics but they are saying the order was confusing in part because there was a written order and a verbal order. I believe only the latter had the order to return the detainees.
Also, they have argued that at the time of both orders the detainees were outside the jurisdiction of the Court.
Plus, his order or orders were overturned by the Circuit court and/or SCOTUS.

Oral orders don't mean shite.

Until it is put into writing and filed into the record, he may as well have been reciting lyrics from Cats.
