Tip of the Day: Up your Auto Liability Coverage

Tip of the day.

A couple weeks ago my BIL (nudes on Reddit) was in an accident. He was pretty messed up, still is, but is going to be ok, thanks for your thoughts and prayers. He's actually living with us for now, he nobody else to take care of him during his recovery.

The lady that hit him was a young mom of two children, married, one of the kids was in the car, they are all OK. Physically.

But my BIL's lawyer (nudes also on Reddit) is going to clean them out and destroy them. Because that's what people like SloFloPro do.

She wasn't driving drunk, or reckless, just made a mistake that fricked up another individual in a very serious way. She's insured, but the bills are much more than the minimum liability coverage.

I see this all going down, and think "what if I got distracted, or otherwise frick up while driving, and seriously mess someone up?" Hospital bills are the big one.

So I go to everyone's favorite insurance website, USAA, and see what it would take to raise my legal minimum liability insurance to a million dollars, and remarkably, it only raised my premium by 17%. Of course I made the change.

I urge you all to up your Liability insurance on your Auto policies. You are one blind spot away from having your life savings wiped out.

Also, since we are talking about odds and such, take UGA +1100 to win it all this year at Fanduel.

That lawyer won’t “clean her out.” He’s going to get the policy limits from her carrier and then go after your brothers underinsured motorist coverage.

Very rarely do attorneys go after someone insured if they have minimum coverage and really no assets. They will run a check on her and determine it’s not worth it because the likelihood of collecting will be so low.

He was on a scooter. There's no insurance there to go after.

No, he’s not. Because the excess judgment is dischargeable in bankruptcy.

You should up your liability limits and then pay for the reciprocal UM coverage.

Then your BIL would be sufficiently covered.

I do this for a living and carry $2.5M in coverage, largely for the UM protection.

If you have full coverage, it is insanely cheap to carry an umbrella policy on top of your other insurance. IIRC my $1M umbrella costs around $5 extra per month.

Well my point still stands. That attorney is going to run a check on her assets. If she only rents and has a low paying job with no other assets he will come back and tell your brother that it’s not worth it to pursue because their likelihood of actually collecting on any judgement will be incredibly low.

With the amount of uninsured drivers and the vast majority that are only have minimal liability, get UM and umbrella UM coverage.

State Farm stopped writing new umbrella policies in Louisiana and have jacked up existing policy holders. Why do you think that is?

No, what if they do own a home, and have 401k's, etc? The lawyer is going to take that shite. That's what I mean by "financially destroy".

Some things are exempt from bankruptcy.

You should up your limits and buy UM.

You BIL isn’t collecting on an excess beyond the insurance coverage.

To add to your tale:
I rear ended someone tonight
I have 250/500, as well as 250/500 UM with a $2mil umbrella
Got out the smoky car, made sure they were okay
Guy who was driver got out, Hispanic, a star tattooed in between his eyebrows
I was like, I’ll get the insurance and call the police. He and his passenger were like, “we’re going to the gas station. We’ll be right back”.
My car was totaled, theirs was fine.
Called the police. They advised me to advise them to stay. I was like lol.

Moral of the story: I won’t have a liability claim. So, if you’re at fault in an accident, make sure to hit someone illegally in our country.

How many assets do you think this person has:

Edit: and 401k are typically shielded from judgements.

Sounds like another great reason to quit my job, file for all the benefits, not have insurance, and when I frick over someone’s life just hit them with the whoopsie and move on. I’ll probably get some stimulus checks along the way for not contributing.

The nice lady who hit your BIL is on the hook for $500k in damages. Her insurance company contractually obligated itself to pay up to $15k on her behalf.

How do you get the $485k from her?

Take the judgment. She files bankruptcy, your BIL is a creditor along with whomever else, he gets next to nothing.401(k) is exempt from seizure, so is the homestead for the most part.

Easier way is for your BIL to have UM (underinsured/uninsured motorist coverage).

Her insurance pays $15k, next dollar comes from your BIL’s insurance up to those limits.
