The Brief Texas lawmakers passed SB 1596, which would legalize short-barrel firearms under state law. These weapons, often called "sawed-off" shotguns, are already federally legal with restrictions. The bill now heads to Gov. Greg Abbott, who will decide whether to sign it into law.

What restrictions? My assumption is the barrel has to be at least a certain length..?

Another pointless relic of the NFA from 90 years ago.

Short-barrel firearms are commonly referred to as "sawed-off" shotguns.

Federal law defines them as rifles with barrels shorter than 16 inches or shotguns with barrels shorter than 18 inches.

These weapons are known for their wide projectile spread, which can cause significant damage at close range.

F'ing ignorant liberal media yelling "sawed-off assault rifle/shotgun/grenade launcher". Seems like anything black with a trigger is an assault weapon in the news. Are we talking sawed off shotguns or short barrel rifles (SBRs) here?

quote:

These firearms are already legal under federal law with a background check and a $200 fee.

It's already legal in Texas as long as the federal tax is paid. They have to follow the federal law just like any other state in the USA.

quote:

SB 1596 seeks to amend the Texas Penal Code by removing “short-barrel firearms” from the list of prohibited weapons under Section 46.05(a). As it currently stands, Texas law criminalizes the possession, manufacture, transportation, repair, or sale of short-barrel firearms, unless they are registered under the federal National Firearms Registration and Transfer Record or otherwise exempt. This bill would strike that provision, effectively decriminalizing these firearms under state law and placing sole reliance on federal regulation for their oversight.

For example:

quote:

To possess an SBR in Louisiana, it needs to be registered with the ATF and a $200 tax stamp must be paid. This applies to both transferring an SBR into a Louisiana gun trust and for a Louisiana gun trust to manufacture an SBR.

quote:

In Mississippi, possessing short-barreled rifles (SBRs) is legal, but they must be registered with the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and a tax of $200 is required for registration.

He wanted so badly to get off his political statement that he forgot to read the entire paragraph.

I thought all of this fell under federal law. What Texas law is currently preventing ownership of sawed-off shotgun AR-47's in 5.56?

From what I'm reading, SBR AR-15's are already legal as long as the purchaser goes through the federal tax stamp process.

Not really. Nobody calls SBRs “sawed off shotguns” unless they are in fact sawed off shotguns.

The law is clear, it’s the article that has no idea how to accurately portray this (media somehow hasn’t figured out pretty easily-understood firearm nuances depsite decades of hyperventilating about firearms).

Put a pistol brace on it and skip the stamp tax.

Can you show me where the article used the acronym SBR?

SBRs are not often called 'sawed-off shotguns.'

The article is a mess. Maybe there is a distinct term in Texas law where "short barreled firearm" means "short barreled shotgun" and doesn't match the Federal definition of an SBR, but I doubt it.

Seems obvious they didn't explicitly say rifle on purpose.

I think what this bill does is remove the State penalties i.e., if the Feds don’t get you, they can’t lean on a local prosecutor to go after you with a state law.
