Louisiana Lemon Law

Anyone familiar with Louisiana Lemon Law? I looked up the parameters and it showed that if the vehicle has been brought in for the same failure 4 plus times; or if the vehicle has been at the dealership for repair for over 45 days and still under warranty, etc....

My vehicle falls under the more than 45 days and no updates or fixes.

Has anyone delt with this? Is it able to be done without an attorney, or do I need to get an attorney involved?

The dealership has told me since day 1 that "parts are on nation wide backorder" and no expected date on arrival.

Not an attorney but I don’t think parts being on back order qualifies your truck as a lemon. I think it’s more to do with they’ve had it for 45 days and can’t figure out what the problem is.

Good luck man. I dealt with a Ford expedition that needed an entire new engine at 9000 miles. Got the run around for months. Spoke to a couple attorneys during that time and they didn’t even deal with ford anymore because they never benefited from it. I think lemon law is a crock of shite.

not a lawyer but pretty much any vehicle you buy you have to agree to the manufacturers terms which have an arbitration clause that definitely isnt in your favor.

Maybe contact the AG's office to see how the law is applied. If anything else, they should point you into the right direction.

It’s not a lucrative field for attorneys.

Call attorney Richard Dalton in Carencro. He does a lot of these cases.

He will know if you have a good case or not.

I’ve had multiple people ask me to rep them for this type of thing, but it’s usually cost prohibitive getting an attorney involved. Best case scenario is finding a lawyer friend to write a demand letter but it depends on what remedy you’re looking for. Are you trying to get out of the sale or demand specific performance of whatever repairs are needed?

I'm looking to have my vehicle back fixed in a week (its been there 56 days), or them refund the sale, or for the dealer to give me an equivalent vehicle to what I have now.

It's 90 days out of service in Louisiana. So you still have more waiting.

You will have one year from the date of last attempt to repair to seek recission of sale, or reduction of price. You can assert claims under Lemon Law statute La. R.S. 51:1941 et seq, and redhibition La. C.C. art. 2520 et seq. You are able to recover attorney fees if you can prove seller knew of the defect and failed to disclose so I would call an attorney. Richard Dalton used to handle a bunch but not sure if he still does. I would not try to do it yourself since their attorneys fight these on a daily basis.

There’s a lot of bad advice in this thread… Find an attorney that specializes in lemon law and schedule a consult. You won’t have to pay for the consult.
