DWI probation…

So we don’t start the back and forth of “stop breaking the law” or “they should be thrown in jail for 25 years”, I had a friend that was an idiot and got one. He was telling me about his probation and it’s a joke. He has to see a PO once a month on a day that is SCHEDULED. No random tests, curfews or visits at home. He has a breathalyzer in the car, but he can easily get around that by driving another car or getting rides. My question is simple. Why not require a person to actually stop drinking vs having simple ways around it?

Because DWI laws exist primarily as a money grab for the state, not about making the streets safer.

If politicians really wanted to save lives the. Every car would have a breathalyzer.

That would be a lot worse than the initial DWI if he got caught. It would also be a financial strain to get another vehicle. When i rented cars we had people who got their licenses taken because of DWI so we couldn't rent to them. If the owner has a second vehicle, they might not need the interlock device, but that carries its own risk. There arent a lot of people with two personal vehicles, so good luck finding someone who is willing to let another person who just got a DWI to borrow their vehicle.

This will be conflicting for lots of people on here. There’s some that apparently get so wasted that they aren’t allowed to board a plane, so getting a DWI is nothing for them. You’re also asking about stricter government or laws or surveillance. I’ll get my popcorn ready.

DUI laws in this country are a joke. It should be attempted murder. Thank the politicians, mostly Republicans. Bush one changed the legal limit law in Texas to protect his drunk kid.

Alcohol has done more damage than any other drug yet it’s legal and advertised heavily.

Because DWI laws aren't actually about safety. They're about money. The vast majority of people are not drunk at .08 BAC.

Actually there are plenty of ways to help “prevent” folks ONCE they are on probation. What about RANDOM testing so you have no clue when you’ll be pissed tested? Had another buddy years ago, that had to blow into a portable device 4 times a days for 6 months. He didn’t drink a thing during this time. I am convinced that for first time offenders it’s a complete money grab. Sad.

That is completely irrelevant. You can and do have to give up rights for the privilege of probation, it is in lieu of sitting in a jail cell. Not drinking is often a condition probation/parole, but maybe not common in LA.

Well when I got my DWI in 1975 it was a $250 fine and forgotten so at least there are more consequences these days.

If we are to assume cops are public servants and MADD type groups cared about public safety, they would be funding things like free Uber codes from bars or having cops do breathalyzers in parking lots of big bars instead of setting up checkpoints a mile away.

DWI’s are for revenue not safety.

Had a guy who works for me here in Germany get a DUI. They take it very seriously here. He paid around 10,000 euro in fines, lost his license for a year and had to submit to weekly hair follicle testing. I’ve learned that the penalty for riding a bike drunk is the same as a in a car.

Yeah, but courts can't levy fines and lawyers can't get paid when everyone is in jail.

So there is your answer.

1st and 2nd offense DWIs are misdemeanors.
After that it is a felony.
The seriousness goes up depending on the number of offenses and the blood alcohol reading.
