2024 was a record year for denying cops qualified immunity. Now we have another landmark case where two cops have been denied qualified immunity. It's a beautiful thing. No one working for the government should be given legal shield to show their arse. Any infringement of rights should be a capital offense.

Good. Nobody should be above the law, period.

This may make it tougher to recruit cops, but if that’s one of the reasons they were joining in the first place then it sort of solves itself.

Absolutely. And prosecutors. The bogus charges againt the J6 protestors and the McCloskeys are perfect examples of them railroading innocent people

It's a tough one. I don't believe in qualified immunity, but I also think we are past the point of no return with a "jury of your peers". If I had stayed in CO and shot someone breaking into my house, a Denver jury very well may still convict me because they disagree with me politically.

I think you have areas of the country that can and will side against the cop every single time, and I'm not sure what the methodology would be to solve that.

I watched that footage in its entirety a few months ago.

That officer got his feelings hurt when the kid was clearly not inebriated. The officer should have just said "sorry kid, I'm trying to keep the roads safe, have a nice night". It would have ended right there.

The officer knew he could violate this kids rights because he KNEW he was going to be immune from any fallout whatsoever. He's probably done this a number of times without repercussion and with the support of his department.

Until there are repercussions for violating the civil rights of citizens, it will continue to happen. Most cops are likely good folks but they apparently aren't around in any of the videos when the others willingly and overtly violate the rights of others. Must be bad luck...

LOL, doubt it, at least as a change in legal doctrine. States can alleviate it here and there at their level. USSC refused to hear an appeal to an appellate court's decision to overturn an original decision that was a pretty good starting point for a general review of the doctrine. And Alabama just passed a law making it easier to gain immunity.

According to court documents, when two police officers arrived to serve Kodi’s mother with misdemeanor arrest warrants (arising from traffic violations), they encountered her with Kodi, a shotgun in her lap. The officers withdrew and summoned more than 30 backup officers. They surrounded the apartment building and cut its power, and hence its air conditioning. When Kodi’s mother went to the kitchen to make him a sandwich, she took her shotgun but pointed it at no officer. Although she seemingly posed no threat of flight or imminent harm, the police corporal, who had been in an adjacent apartment, and who testified that he knew Kodi was somewhere behind the kitchen’s drywall partition, fired his rifle at the mother. The bullet hit her in the back, ricocheted off the refrigerator and struck Kodi’s face. The corporal then entered the apartment and killed the mother with three more shots, one of which shattered Kodi’s elbow. His injuries required multiple surgeries.

In a suit filed on Kodi’s behalf, a jury awarded him monetary compensation for violations of his constitutional rights. But an appellate court found that no “well-settled law” established that an innocent bystander has a right to be free from injury from a gunshot intended for someone else. So, the “hot” and “frustrated” corporal was protected by qualified immunity.


Sucks, but I don't think it's going anywhere yet. It's popular/courageous to accuse someone against QI of being against law/order or not supporting the police.

Everyone expects perfection in an imperfect world. Unfortunately, bad shite happens. Don’t know anything about this instance but if you are armed like the mother was, FAFO. Why was she armed? What was she going to do?

Easy to Monday morning QB situations. Everyone does it and it’s only getting worse.

My comments have literally nothing to do with this particular instance. I didn’t even click the link. I’m simply saying nobody is above the law and qualified immunity allows cops to almost literally do what they want with no repercussions. And that’s a bad thing.

Same thing as the immunity for pharmaceutical companies. I think that’s bullshite and a bad thing as well.
