The Trump administration insisted Sunday that it has no legal obligation to arrange for the return of a Maryland man illegally deported from the United States, arguing that a Supreme Court ruling last week only requires officials to admit him into the country if he makes it back from a high-security prison in El Salvador.

Justice Department lawyers told a federal judge that they don’t interpret the Supreme Court’s Thursday ruling — that the administration “facilitate” Kilmar Abrego Garcia’s release — as obligating the administration to do anything more than adjust his immigration status to admit him if El Salvador’s government chooses to release him.

A unanimous Supreme Court creates a legal duty.

Your honor, what influence or jurisdiction does the United States have over El Salvador and between its own people?

Case closed.

the man is in his home country that he is a citizen of. where in the Constitution does it give the executive branch the right to invade a sovereign country and kidnap their citizens?

All the ruling said is that they need to “facilitate” his release from custody in El Salvador, not return him to the US. If he does return, then the order says he should be afforded due process. It then remanded the case to the district court to clarify what “effectuate” means knowing that the exec branch has deference over matters pertaining to foreign relations—essentially, we can’t force another country to send us one of their citizens.

“Facilitate his return” does not equal “shall return.”

What does facilitate mean exactly?

Therein lies the problem. Even 9 USSC justices can’t write clear legal doctrine to an equal co-branch of government. Pathetic.

I stopped working in my yard today for 5 minutes. I sat on my front porch and drank a beer. No one tried to deport me to a El Salvador prison. Guess what? Legal citizens and those here on legal status didn’t get deported either. I am not sure what this hombre did but it was serious enough for him to make it on a list you don’t want to be on. He wasn’t illegally deported. He was here illegally. He was deported under efforts to round up Venezuelan gang members. Well he is a gang member just not that particular variety.

That clown is leading an intimidation campaign that has US citizen students on that campus of Jewish ancestry living in fear. That alone should make him deportable.
