UNIONDALE, N.Y. (WCBS) - A New York City funeral home company is now being sued by two families. It’s after, what they call, an unforgivable mix-up.

A body shipped out of the country for a burial was the wrong one.

When my family members opened the box, the casket, they realized it wasn’t him,” Leonor Valenta said.

While mourning the death of her children’s father, 39-year-old Elder Emilio Garcia, and watching his funeral via live stream from Guatemala, loved ones saw it wasn’t him.

A 96-year-old woman was in his casket.

The Rivera Funeral Home in Corona Queens sent the wrong body to Guatemala, where Garcia, a Queens father and waiter, was to be buried alongside his parents.

The family says the funeral home seemed to have no idea where his body was.

“What they did was really heartless because they were very stubborn with us,” Valenta, who was Garcia’s sister, said. “He never left the funeral home. He was there the whole time.”

Attorney Philip Rizzuto now represents both families.

“The funeral home denied that they made a mistake,” Rizzuto said.

The older woman was Carmen Maldonado. Her body was supposed to have been sent to Ecuador.

Maldonado’s family only found out she was mistakenly sent to Guatemala via the TikTok post.

Meanwhile, after 10 days, the bodies were properly buried in the correct countries.

That's fricked up.

At least they got it figured out but just admit you fricked up and live with the consequences.

How did this gentleman die at 39?

It’s weird that it’s 2025 and we are still putting dead people in boxes and burying them

I'm curious how often funeral home "mixups" occur. My brother inlaw's mom passed recently, and when we got to the grave side service, it was in the wrong place. Apparently they had buried someone else where his mom was supposed to lay. From what the funeral home was saying, they can't just correct the mistake, because it is technically exhuming a buried casket.

They ended up comping the service and burial, and went through the steps allegedly to resolve the problem. I say allegedly, because I don't think anyone was there to verify what was happening.

I don't particularly pass judgement on people's end of life wishes, but my personal philosophy is that I don't have an ounce of care what happens with my carcass when I pass on. Dispose of me the cheapest and least resource intensive manner possible.

Recently happened to a family of a friend
Service was in BR, family went in for early viewing & it was someone else in their parents clothes
The parent was in MS
They went ahead with the service after moving the casket from the room & offered the family time the following day for viewing

It really is. And paying about $15K to do so. I can haul a ton of debris to a landfill near my house and pay $43 and dump it. My MIL weighed about 80 pounds when she succumbed to lung cancer and it cost us nearly $15K almost 15 years ago to basically do the same thing with her body.

While I agree there was the case years ago about the crematorium in Georgia where the son of the original owner had not actually cremated a body in years but had simply buried them about the place....damned if you do, damned if you don't
