Sadly, I'm not sure it even matters. I don't think these judges believe they can win, I don't think they even care - the objective is just to gum up the works. You know... #resist
Take the MAL documents case as an example.... The legal precedent was iron-clad. You had the PRA, we had the Clinton Sock Drawer Case, the FBIs mishandling of evidence, leaking, collusion, we even had a simultaneous Biden documents case... and the left STILL aggressively went after Trump - even after Biden lost, Smith refused to let it go. The objective isnt the law, its to inflict maximum damage.

I think the reason some people are uncomfortable with this is the "terrorist" designation not being subject to any review whatsoever, plus some murkiness over the "war" part (yes, I know the invasion/predatory incursion part).
