Doctors win lawsuit against Blue Cross Blue Shield

It’s worth $421 million. Good for the doctors for fighting them but I guess all of our premiums are probably going up even more now.

I would like to see the calculations for this award that a jury did in 2 hours. Being out of network they were likely getting a lower % and after a larger deductible and larger out of pocket maximum to be met by patient. The average rate they accept from other insurances would be important, because prices are always over quoted and what’s accepted is always lower.

Maybe she just wanted the most advanced care and procedures that should be widely provided for these women?
I spent 8hrs at the center today while my mother underwent her 3rd surgery at this facility. Her previous double mastectomy surgery and reconstruction were done in MS; this led to the need of a reconstruction correction. Choosing these doctors and their facility didn’t have a mfn thing to do with wanting to go to a ‘bougie place’.
Insurance bs and inflated medical billing are a major problem and no doubt a drain on many due to skimming, scamming, and unethical practices. However, I do hope this niche medical group is adequately compensated for their much appreciated expertise. The service they provide these women is pretty incredible.
I hope none of your wives, daughters, or mothers ever have the need to frequent their facility; however, if by unfortunate circumstances they do, you will have a huge respect and appreciation for the awesome care this team provides.

Paying less for out of network centers and doctors isn’t reducing the patients benefits. Lower % paid along with higher deductibles and higher out of pocket maximums for out of network centers and doctors are what you usually sign up for. Some plans may not pay anything for out of network. The center gets 80% if its patients from out of state which adds another variable into this.

Also they had 2 cases dismissed at federal level before going state route. It could have been for purely procedural reasons, but I don’t know anymore than following quote -

I begged my mom to go there when she had breast cancer the second time in 2012 bc we personally worked with Dr. Trahan in residency. She said insurance wouldn’t cover it (she’s an LCMC employee). Instead, The surgeon that did her reconstruction at a NOLA hospital that was covered butchered her. Her wounds from graft Harvest sites on the back of her thighs dehisced (opened up) day 1. She had wound vacs for 6 weeks. Then when she finally healed she got septic from her port. I agree they are the best at what they do. Fwiw, the hack who operated on her is no longer there.

The center never wanted to go “in-network”. They made more money being out of network. To go in network they would have had to negotiate a rate with very little bargaining power while their out of network rate is an average of what other providers get paid (Ochsner and LCMC have huge bargaining power). $421 million dollars is ludicrous by any account and anyone cheering it while also complaining about health insurance doesn’t understand how any of this works.

Amazing how a complex legal contract issue goes to 12 New Orleans jurors to decide hundreds of millions... I’m sure the jury understood everything real well.

Pretty sure these guys revolutionized reconstructive breast surgery with nipple sparing mascectomy. This is where you would bring any woman that you loved.

Doesn’t mean they don’t inflate prices billed to insurance companies or that patients don’t know that their insurance coverage for out of network would be much less and have to make up the difference. For a procedure or doctor visit I can go anywhere I want to go, but I know up front if I choose out of network I am responsible for anything not paid by insurance and know limits on out of network coverage versus in network. Besides a lower % of what’s considered a more typical rate the deductible is much higher and there is a higher out of pocket maximum (I have seen much worse out of network coverages than we currently have). The patients choose to make up the difference when they go out of network.
80% of patients coming from out of state with the center trying to negotiate with each state’s respective Blue Cross seems problematic from the start on getting patient and insurance on same page especially out of network which can differ from employer to employer and also state to state.

This reminded me of my wife getting put on the jury of a large dollar amount business dispute where both sides only spoke manderin which all had to be translated to jury and judge and so on. One side was Chinese based in states and the other was based in China. My wife always came home with a glazed look and ready to take a nap. They ended up settling after a week.
