Land owner should rent it out.

I'm amazed you can buy lots so cheap on Hawaii

Well, it WAS at sheriffs sale for back taxes.

The frick?
So she's forced to give them $250,000 because they accidentally built something on her property? frick THAT.

Why should she even pay 50 percent if they built it on the wrong lot. Its not her fault the company fricked up.
Agree and if she is willing to fight them in court for years she would almost certainly win
Or she could settle and make a profit now

She will have the option to just enjoy her lot, now with the house on it, without being disturbed. However, the builder will likely be allowed to file a mechanics lien onthe property for the cost of the house. So, if she ever went to sell the property, that lien would have to be satisfied / paid.

Similar situation happened back in the '70s in Chateau Estates in Kenner. But thevlot owner discovered the house being built when it was still under construction.

To add insult to injury, Reynolds is being sued by the property’s developers. The developers say they offered to swap Reynolds a lot that is next door to hers or to sell her the house at a discount.
Who the frick do these twats think they are? They frick up yet sue her because she won’t take their offers for fricking up?
I’d say give me a million or the house for free

That's repugnant. A good firm would see the easy money on this case a work it knowing they'll get their fees covered at no cost to her.

It's $500k for the structure, not the land, correct?
Posted on 3/28/24 at 4:59 pm to CatfishJohn
I hope she counter sues and gets a big payday..

She needs a 100% discount. They screwed up, cleared the land, and built the house on the wrong property.

Having spent some time in Hawaii, dealing with Hawaiin workers, I'm not at all surprised by this.
Have to agree with you on that.
What’s hard to figure, is (a), how she managed to pick up a piece of land in Hawaii for $22,000 tax value (must be a tiny piece of land), and (b) how they managed to build a house only valued at $500,000.
Must be a tiny house. Construction costs there are sky high.

If Hawaii has anything close to unjust enrichment, she won't.

Hope ur trolling.. if not, then you have really lost the plot.. not to mention your moral compass .
This is 100% on the developers and their cohorts..
I think he’s right. If she paid them half the cost of the house she would be in great shape. Alternatively, she could quit claim her interest for $250k.
If she tries to get more aggressive than that it risks the developer offering to return the property to the pre-build condition.
Posted on 3/28/24 at 5:18 pm to HubbaBubba
Absolutely no way she should accept anything except all persons to vacate the property immediately $$$ to pay the addition property taxes she is now responsible for.

Builder should offer to buy the lot at 50% of the home value then sell to break even.
Why would anyone agree to that?
Posted on 3/28/24 at 5:20 pm to HubbaBubba
They did not say if the property was fee simple or leasehold which could further complicate this matter.

Her options should be to keep the house as is at no cost to her, or have the property returned to its original state at no cost to her, and in both cases have all her legal fees covered by the developer who fricked up
She’s now on the hook for additional property taxes. There are actually damages here if the idiot developers just left the property alone today.
Don’t frick with someone else’s property.
