Does that fit your definition of “incoherently drunk”?

I was using the term the guy I responded to was using which I quoted in my response. Did you not read that part?

What if the young men were drunk too?

And? Are you saying being drunk excuses a crime? A lot of guys with DUIs should have used that defense I guess.

It seems like a lot of people on this thread trying to sugarcoat having sex with an incoherently drunk woman.

The word consent blows your entire narrative.

What a horrible analogy. I don’t know what they have video of, but if it’s her consenting to sex and talking shite to the one dude that didn’t do it, that certainly doesn’t help her case. I guess it all comes down to what the court deems counts as consent from a drunk person/persons (on both sides of the coin).

I’m interested to see how this trial pans out. And I feel bad for her family that is gonna have to sit through some very uncomfortable things I’d imagine.

If they had said video, why not get it out early?

I think it's horseshite.

This discussion is more about how the law (specifically criminal law) completely changes the culpability of drunk people somewhat at random

If she was blind drunk to the point of being incapable of consent, that is rape under Louisiana law (and the law of a lot of other jurisdictions).

It may very well be horseshite. I don’t know what they have or not. I’m only saying if they do then that will likely hurt her side.

I have seen lots of the videos. I eat lunch where one of the kids works and he is a very nice guy. (The driver). All that being said the videos don’t make her case sound the way the media has spun it. It’s a terribly unfortunate thing that happened. This case will be all over the media and all parties including Madison will be made to look terrible. It’s the defense plan to portray her that way. Nothing good will come of this except bashing a poor dead young woman.

Not the case. He’s been nothing but nice. I didn’t even know who he was until they came and arrested a few weeks ago during lunch.

Bet you’d have a totally different outlook if that had been your daughter.

Depending on the nuances of criminal law two or maybe all three will be convicted of a sex crime. Likely the two men who committed the sex acts will be convicted or allowed to plead down to a lesser crime to avoid a trial.

The driver may be convicted or plead to accessory to the crime but his culpability seems less clear. He was giving Madison a ride and he was not responsible for what happened in the back seat. Did he try to stop it? Could he have done so? Getting a conviction of substance may be difficult.

It will be much harder to get a conviction for her death as they left her at the entrance to a subdivision and didn't just make her get out in the middle of a busy road.

This isn’t wrong. She didn’t deserve what happened to her but she wasn’t an innocent girl walking home. She was a known drunk who took things too far and she ran after the guys to ride with them. There’s videos of her encouraging them to have sex with her. Again, it went too far but she isn’t a pure innocent young girl.

Clarify what you mean. She has some fault for putting herself in the situation she was in. But that's it. It does not excuse what those young men did nor does it mitigate it at all. No more than leaving your car unlocked in your driveway or door unlocked on your home excuse or mitigate the actions of a thief.

The car door analogy is stupid. The videos show her making fun of the driver and calling him gay because he wouldn’t have sex with her. She played with fire and she got burnt. It’s terrible that I have to say it, but it’s the truth. She played a stupid game. She got belligerent drunk and hopped in a car with a bunch of shithead trashy guys.

Did she deserve any of it? No. But her actions put her in a higher risk situation.

if he wouldve just fricked her then took her home he wouldn't be being charged with anything.

Jesus punished him appropriately for having the gay
